Samsung Z Fold 3 class action overview:

  • Who: Antonio Lewis filed a class action complaint against Samsung Electronics America, Inc.
  • What: The plaintiff alleges the Samsung Z Fold 3 phone has defects related to its fold functionality.
  • Where: The lawsuit was filed in New York federal court.

Antonio Lewis filed a class action complaint against phone maker Samsung, which alleges that the Z Fold 3 phone’s folding technology does not live up to promises of durability.

According to the lawsuit, Samsung promotes in its advertising that the phone holds up to rigorous tests, saying it can be folded and unfolded more than 200,000 times, the equivalent of five years of usage.

The Samsung Z Fold 3 class action, however, alleges that the phones have a high percentage of screen failures, which begin with a minor crack or a crack running the length of the fold.

The lawsuit claims the Samsung Z Fold 3 is “highly susceptible to screen damage, including corrupted pixels, through microscopic particles getting under the protective film at the hinge, creating air pockets.” The lawsuit also alleges that cold temperatures can cause the screen protector to snap instead of bend.

Faulty testing didn’t include real-world use, Samsung class action claims

The lawsuit claims that Samsung’s testing environments did not include real-world applications that expose the phones to environmental factors such as temperature swings, dust, sweat, water and normal day-to-day handling of the device, all of which can affect the durability and functionality of the hinge.

The plaintiff bought the phone for around $1,800 in 2021, he claims. When his phone was no longer functional after less than one year of use, Lewis attempted to get coverage from Samsung, but he alleges he was told screen repair was not included. He was told the repair would cost him more than $500, according to the Samsung Z Fold 3 class action.

The class action complaint alleges that Samsung used “unfair, misleading and deceptive representations, omissions and actions” in selling the Samsung Z fold 3 phone. It claims Samsung violated New York Business Law, the Virginia Consumer Protection Act and state consumer fraud acts (which cover North Dakota, Wyoming, Idaho, Alaska, Iowa, Mississippi, Arkansas, North Carolina and Utah). The Samsung lawsuit cites breaches of contract, express warranty, implied warranty of merchantability/fitness for a particular purpose and the federal Magnuson Moss Warranty Act.

Samsung has faced legal action over folding devices before. A class action lawsuit in 2021 claimed laptop hinges, marketed as a 2-in-1 tablet device, were also defective.

    Pleas add me
I have a flip phone and had get the screen replace twice.

With both the manufacture warranty and insurance on the phone how are they still denying coverage and having people pay for the repair at a quarter to half the cost of the whole darn phone? They are making a profit off of their faulty screen. With this being an issue from roughly 2021 to currently 2026 ( which by the way should have been the length of time the screen was claimed it would withstand being folded) there have been nothing but complaints about the screens on these phones not holding up as was advertised and to top it off after being made aware of the screens faults and issue and seeing them themselves with each repair or replacement, i find it appalling that they continue to use the same faulted screen design it each of the following upgrades from the z flip , zflip2, zflip3, zflip4, zflip5, zflip6, zflip7, z fold, fold 2, zfold3, and continuing with the next new generational phone this year of the z flip8. And everyone of these models have had similar or even the same exact issue. And they will not admit it is a design or manufacturing flaw because they will lose money on these phones and also the extra profits they are making by declining the warranty and now many times the insurance as well to make more money on their flaw by putting the blame on the customer. Clearly they are falsely advertising their product, the coverage they provide and let’s be real honest. They are now knowingly selling people phones they KNOW have a defect and not only are they still selling them with that knowledge, they are, have and continue to make more of the same faulty product purposefully. How can anyone see the same issue happen over and over and honestly believe there is NO problem with their design. That hundreds upon hundreds of people tend to abuse their phones in the same exact way to create the same exact problems? Not the shell, not the cameras, not the side rails, not the back area that is always exposed to the outside elements, but always the screen that is inside the outer hard protective shell that is somehow being battered during its sleep. Samsung is the one causing abuse to their customers. Charging them over and over for their flawed design or be without a phone while you are still paying for it or it’s service. Or purchase another phone from them. 5 years now. When will something be done about their actions or should I say inaction. They have bleed enough out of us for the junk they are selling at a premium cost. I could find a car that runs better for $1000! And they have the nerve to be charging upwards of $3000? This is no longer a reputable business. Its gall and greed! And sheer insanity to let this continue unchecked. I for one demand a lawsuit be opened against them and their unlawful business practices, false advertisement, unlawful claim denials, false accusations of their customers actions and entrapment in sales and repair fees..while they make no effort at all to make a change or improvement to what they now cannot say they are no longer aware of this issue. Let our voices be heard!

I agree Samsung has been very deceptive in its claims on ALL galaxy z flip phones and fold phones screen durability, screen protector, hinge issues and warranty denials sighting fault of the customer each and every time. However the issues are very similar or even exact at times between different people with different flip or fold phones. Always the same type of screen issue where it starts as a small black inkish spot some where and continues to grow rendering the screen unusable. Or the screen showing lines or cracking along the middle or fold area. Many have the same issues with the hinges where the phone no longer opens all the way. Or the phone will shut itself off due to the internal structures getting pinned or pinched by the hinge internally. Or the screen protector starts to peel off starting at the fold area and quickly deteriorates from there. Or dead pixel area within the screen, or a white or green line going through the screen usually any where from top to bottom or at the middle fold area
Not from excessive use or abuse nor from drops or other claims the company has accused the customer of. Thrse phones are selling from $900.00- $3000.00 each. And they claim the foldability of these phone can with stand folding for up to approx 5 years. 80% of these phones with the folding screen will come to have these issues within the first year or sooner. And any little blemish on the casing anywhere is given to the customer as an excuse for them to disregard the warranty to repair the screen and charge the customer anywhere from $300 for the replaced protector on upwards of $600 with them stating the customer mishandled the phone causing a tiny scratch or blemish anywhere they can find one and claim this was the cause of the screens failures and it is not covered under warranty as it is not a manufacturer defect. HA! then why i ask does it happen to every model of zflip and fold phones with the same type of folding screen and hinges? Every model every year and it is almost always a screen problem each and every time on each and every phone. The area of the phone that was supposed I used to be the most protected because it folded closed to encase and protector it’s screen when not it use and in a pocket or purse. Yet that is the exact area the trouble start and are dismissed as consumer negligence. Odd how similar this negligence is from person to person in all situations and all fold and flip models and years having the same screen issues over and over and over again between thousands of persons. I myself have had these issues with 3 z flip phones 2 z flip 3s and 1 z flip 4. And always under a years time and having been denied warranty repair even with care +.
Can thousands of people and thousands of phones with repeating issues all be wrong. The issue is a faulty screen and it’s bad design not the fault of people using a phone made to be used and of course folded.

  4. Darren L Webb says:

    7 month old Flip7,

Black line across the crease, touch screen unresponsive.

Phone installed in a hard case.

Never been dropped or gotten wet.

    Samsung denied warranty.

I’m all in for lawsuit if that helps.

Would rather have Samsung honor their warranty and repair my phone.

  5. Melissa Blackwelder says:

I had the same problem with my Zflip within the first 6 months. First time it was covered under insurance. Next time it went out was about 4 months later and I lost everything. Every picture, concert video, birthday party pictures, contacts, everything. I had to get a new phone with a new line because I couldnt upgrade the flip since it was only a few months old. This phone sucks so bad we deserve compensation for what we lost and spent

  6. Vindoini Epparla says:

I have purchased samsung galaxy flip 5 in June 2025 and I am facing the same issue.

  7. Michelle Ujah says:

How do I join this class action? I do not see a place for this. I am on my 4th phone and they charge me $100 everytime for a replacement.
