  • Who: Baby food customers filed a class action lawsuit against Walmart Inc.
  • Why: Plaintiffs allege Walmart failed to disclose to consumers that its Parent’s Choice brand baby foods contain high levels of toxic heavy metals.
  • Where: The class action lawsuit was filed in Arkansas federal court.

Walmart manufactures, markets, and sells baby food that contains high levels of toxic heavy metals such as cadmium, mercury, arsenic, and lead, a new class action lawsuit alleges.

Lead plaintiff Rebecca Abbott claims Walmart knows its Parent’s Choice brand baby food contains toxic heavy metals which can cause babies to suffer irreversible brain damage

Abbott wants to represent a nationwide Class of Walmart customers who purchased the affected baby food products without knowing they contained high levels of toxic heavy metals.

Walmart was part of a group of baby food manufacturers implicated in an investigative report released in February by the Subcommittee on Economic and Consumer Policy Committee on Oversight and Reform of the U.S. House of Representatives.

Abbott claims she purchased a variety of Walmart baby foods to feed her children, including cereal, rice, oatmeal, fruits, and vegetables. She would not have purchased them if she knew they contained heavy metals, according to the class action lawsuit.

The Food and Drug Administration (FDA) and the World Health Organization have both declared that toxic heavy metals are dangerous for humans — and especially for babies and children.

“Babies’ developing brains are exceptionally sensitive to injury caused by these toxic heavy metals, and several developmental processes have been shown to be highly vulnerable to chemical toxicity,” the class action lawsuit states.

Abbott claims even small amounts of exposure to toxic heavy metals can lead to irreversible brain damage and increase the risk for future problems with intelligence and behavior.

“There is no established safe level of toxic heavy metals for babies. Any amount is too much,” Abbott said.

Walmart ‘Refused to Cooperate’ with Investigation into Levels of Heavy Metals in Their Store-Brand Baby Food, the Class Action Alleges

Walmart refused to cooperate with the Subcommittees investigation, according to the class action lawsuit, which says independent testing was able to confirm on its own that its baby food contained “concerning levels,” of toxic heavy metals.

Abbott alleges that, despite knowing this, Walmart failed to disclose the information to consumers through any of its advertising, labeling, or branding, and instead continued to manufacture and sell the product like normal.

The plaintiff lodged a total of 61 counts against Walmart, with charges including, but not limited to, consumer protections violations, deceptive trade practices, and false advertising.

Abbott is demanding a jury trial and requesting Class certification and damages for herself and all Class Members.

Multiple other class action lawsuits have been filed against Walmart in relation to the Subcommittee’s findings on toxic heavy metals, including in Arkansas and California

Sprout Baby Foods, which was also named in the Subcommittee’s report, asked a New Jersey federal judge in August to dismiss a class action lawsuit alleging it sold baby food containing toxic heavy metals, arguing it is the FDA’s job to regulate acceptable levels.

And the list goes on. I also feed my son who has been diagnosed with autism and ADHD Gerber and Parent Choice baby foods. Someone needs to be responsible and take accountability for not informing and producing such toxicity to profit from vulnerable mothers with newborn babies. Wondering if said individuals feed their own children these brands of products knowing the circumstances and results from the toxic waste?!

  2. Angel Lemire says:

I’ve been feeding my baby only this brand of products since he started solid food I would have NEVER gave it to him if I’d known what it would have done. He throws it up almost immediately after eating and has been incredibly irritable since starting foods, I am suspicious this to be the reason
