All Elite Wrestling Class Action Lawsuit Overview:
- Who: Plaintiff Luigi Abreu has filed a class action lawsuit against All Elite Wrestling LLC.
- Why: All Elite Wrestling’s website is allegedly not accessible to blind and visually impaired individuals in violation of the Americans with Disabilities Act.
- Where: The All Elite Wrestling class action lawsuit was filed in New York federal court.
All Elite Wrestling LLC violates the Americans with Disabilities Act (ADA) by operating a website that is not independently usable by blind or visually impaired individuals who use screen-reading software, an ADA class action lawsuit alleges.
Plaintiff Luigi Abreu says that he attempted to make a purchase on All Elite Wrestling’s website www.shopaew.com in April 2022. However, as a legally blind person who uses screen-reading software to access webpages, Abreu says he was unable to independently use the website to set up an account and purchase products.
“For screen-reading software to function, the information on a website must be capable of being rendered into text,” the All Elite Wrestling class action lawsuit states. “If the website content is not capable of being rendered into text, the blind or visually impaired user is unable to access the same content available to sighted users.”
The All Elite Wrestling class action lawsuit points to several issues with the website’s screen-reading software. The issues allegedly involve the narrator’s inability to fully read the website, particularly the links, CAPTCHA and names of the items sold on the website.
All Elite Wrestling Class Action Says Website Has Failed To Provide Equal Access
Because All Elite Wrestling has failed to remove access barriers to its website, blind and visually impaired individuals are denied equal access to the website and the products it offers, the ADA class action lawsuit alleges.
Abreu filed the All Elite Wrestling class action lawsuit on behalf of himself and a proposed class of other visually impaired and/or legally blind individuals in the United States who have attempted to use the company’s website but were unable to use it independently in the past three years.
Procter & Gamble has also faced a class action lawsuit alleging its website violates the ADA because it is not independently accessible by legally blind and visually impaired individuals.
Abreu is represented by Edward Y. Kroub, Jarrett S. Charo and William J. Downes of Mizrahi Kroub LLP.
The All Elite Wrestling Class Action Lawsuit is Luigi Abreu v. All Elite Wrestling LLC, Case No. 1:22-cv-03601, in the U.S. District Court for the Southern District of New York.
