Plaintiff Erika Alexandria filed a class action lawsuit against Panama Jack International Inc., claiming the company’s website is not fully accessible to those who are blind or visually impaired, a violation of the Americans with Disabilities Act (ADA).

Websites are accessible if they incorporate things such as alternative text, accessible forms, descriptive links and resizable text; however, the Panama Jack website relies on visual representation that excludes those who are visually impaired, according to the class action.

“Due to Panama Jack International’s failure and refusal to remove access barriers to panamajack.com, blind individuals have been and are being denied equal access to Panama Jack International, as well as to the numerous goods, services and benefits offered to the public through panamajack.com,” the lawsuit claims.

Panama Jack website inaccessibility violates both federal New York laws, lawsuit claims 

Alexandria seeks both federal relief under the ADA and relief for a New York subclass based on New York’s Human Rights Law and Civil Rights Law, according to the Panama Jack class action lawsuit. The class is asking for permanent, injunctive and declaratory relief, damages and attorney’s fees.

Hasbro is also facing a class action lawsuit filed in federal court in New York stating its fan website is inaccessible to those who are blind or visually impaired.
