Plaintiff Vordaliza Taveras claims she attempted to use the Humble Brands website April 13 to purchase a Moroccan Rose deodorant product but was unable to purchase the item due to access issues.
The Humble Brands website fails to use alt text on embedded images, which is crucial for screen-reading software utilized by those who are blind and visually impaired, according to the Humble Brands class action.
Taveras uses NonVisual Desktop Access, one of the most popular screen readers for personal computers, but was unable to navigate the website because of both the lack of alt text and the use of drop-down menus.
Taveras looks to represent visually impaired and/or legally blind individuals in the United States who attempted to access the website and have been denied equal access, according to the Humble Brands class action lawsuit.
Humble Brands violates Americans with Disabilities Act, class action claims
The Humble Brands website access issues violate the Americans with Disabilities Act and the New York Human Rights Law, according to the Humble Brands class action.
Taveras seeks statutory and punitive damages, along with attorneys’ and court fees and declaratory and injunctive relief.
In related news, Glamorise faces a similar class action lawsuit alleging it does not allow equal access to its website to those who are visually impaired and legally blind.
