A legally blind woman who uses a screen reader is suing Madame Alexander Doll and Jackbox Games, saying the companies websites are not accessible to those using a screen reader.

Plaintiff Sharon Joyner filed the class action lawsuits against Madame Alexander Doll and Jackbox Games June 28 in a New York federal court, alleging violations of the Americans With Disabilities Act and New York City Human Rights Law.

According to the near-twin lawsuits, the companies have failed to make their websites fully accessible to her and other blind or visually-impaired people who use screen-reading software. 

Joyner said, in April 2022, she browsed and attempted to transact business on one of the company’s websites, www.madamealexander.com, which sells baby dolls.

However, there were multiple barriers to accessing the website. including a link out in the shopping cart that reads “btn/btn_bml_text” with no explanation, the lawsuit alleges.

“Plaintiff was highly interested in purchasing the products offered by Defendant. Plaintiff remains hopeful that the accessibility barriers will be cured expeditiously,” the lawsuit states.

Unable to put items in shopping cart, lawsuit alleges

Also in April 2022, Joyner browsed and attempted to transact business on Jackbox’s website, shop.jackboxgames.com. The website sells quiz-based party video games.

However, she was unable to place things in her shopping cart and a number of links were placed without descriptions. 

“The access barriers Plaintiff encountered have caused a denial of Plaintiff’s full and equal access in the past, and now deter Plaintiff on a regular basis from visiting the website, presently and in the future,” the lawsuit alleges.

“These access barriers have deterred Plaintiff from learning about the various products sold to sighted individuals because Plaintiff was unable to determine and or purchase items from its website, among other things.”

In both cases, Joyner is seeking a permanent injunction, declaratory relief, damages, interest, fees, costs and a jury trial.

In both cases, she’s looking to represent all visually-impaired or legally blind individuals in the United States who have attempted to access the company’s website, plus a New York City Subclass.
