Bradford Exchange website class action lawsuit overview: 

  • Who: Mykayla Fagnani filed a class action lawsuit against The Bradford Exchange Ltd. 
  • Why: Fagnani claims Bradford Exchange failed to make its website fully accessible to individuals who are blind or visually impaired. 
  • Where: The class action lawsuit was filed in New York federal court. 

Bradford Exchange failed to make its website fully accessible to individuals who are blind or visually impaired, a new class action lawsuit alleges. 

Plaintiff Mykayla Fagnani claims Bradford Exchange failed to design, construct, maintain and operate its website so that it is independently usable by individuals who are blind or visually impaired. 

Fagnani argues Bradford Exchange ultimately denies full and equal access to its website to individuals who are blind or visually impaired in an alleged violation of the Americans with Disabilities Act (ADA)

“Defendant deprives blind and visually-impaired individuals the benefits of its online goods, content and services—all benefits it affords nondisabled individuals,” the Bradford Exchange class action states. 

Bradford Exchange website allegedly not compatible with screen-reading software 

The Bradford Exchange website contains access barriers that make it not compatible with screen-reading programs used by individuals who are blind or visually impaired to browse the internet, the Bradford Exchange class action alleges. 

In addition to allegedly violating the ADA, Fagnani claims Bradford Exchange violates the New York City Human Rights Law and the New York State Human Rights Law

She demands a jury trial and requests declaratory and injunctive relief along with an award of compensatory, statutory and punitive damages for herself and all class members. 

Fagnani wants to represent a nationwide class and New York subclass of legally blind individuals who have attempted to access the Bradford Exchange website and been denied access to the equal enjoyment of goods and services offered on it. 

A consumer filed a similar class action lawsuit earlier this month against Strand bookstore, arguing the company failed to make its website fully accessible to individuals who are blind or visually impaired.
