The Los Angeles County Sheriff’s Department has agreed to a $14 million settlement to resolve claims it inappropriately detained and refused to accept payment when people on U.S. Immigration and Customs Enforcement hold, or ICE hold, attempted to post bail.

Three groups of individuals may be eligible to benefit from the ICE hold settlement:

  • Detention on ICE holds: Class Members detained between Oct. 19, 2010, and June 14, 2014, at a Los Angeles County jail after their criminal charges were resolved. This Class does not include individuals who had prior deportation orders or those who already were in deportation proceedings when the ICE hold was issued.
  • Booking Arrestees Who Should Have Been Released Due to Low Bail: Class Members who had an ICE hold and were booked into jail on charges with a total bail amount of less than $25,000 between Oct. 19, 2010, and June 14, 2014. Exceptions will be reviewed individually.
  • Refusing to Accept Bail: Class Members for whom the sheriff’s department denied the right to post bail between Oct. 19, 2010, and Oct. 18, 2012, because they had an ICE hold.

The settlement is the result of a class action lawsuit filed in 2012 by immigrants who claimed they were unlawfully detained by the L.A. County Sheriff’s Department due to ICE holds, according to a news release.

A federal court ruled the sheriff’s department’s jailing of individuals based solely on ICE holds was unconstitutional.

Former Los Angeles County sheriff Lee Baca was in office during most of the period in which the violations took place, the news release said. 

He is serving a three-year prison sentence for obstructing a federal investigation, according to the Los Angeles Times.

ICE Hold Settlement Benefits

Class Members in the ICE hold settlement may be entitled to up to $1,000 per day they were held on ICE hold before their criminal charges were resolved.

In addition, Class Members may be entitled to up to $1,000 per day for each day spent on ICE hold after they were able to be released on their criminal charges.

Certain Class Members not permitted to post bail also are eligible to receive $250 for the violation of their right to post bail.

Each Class Member’s benefit is capped at $25,000.

A final hearing in the Los Angeles County Sheriff’s Department ICE hold settlement is scheduled for Nov. 19, 2021.

Those wishing to opt out of or object to this settlement must do so by Oct. 10, 2021.

The deadline to file a claim is also Oct. 10, 2021.

Who’s Eligible

    i was told I was approved for this settlement and told I would recieve a payment sometime after 11/10/2020 but I never recieved any payment and they started to ignoring me since: 12/01/21.
