Tommy Hilfiger lawsuit overview:

Ugg footwear designer Deckers Outdoor Corporation has filed a patent infringement lawsuit against MBF Holdings LLC for allegedly selling Tommy Hilfiger footwear that infringes on certain patented Ugg designs.

In the Ugg lawsuit, Deckers argues that MBF has sought to capitalize on the popular Ugg “Fluff Yeah” fluffy slides by selling similar Tommy Hilfiger brand “Laydown” fluffy slides.

The Fluff Yeah Slide, a “unique and inherently distinctive” combination of slipper and sandal, was introduced in 2018, the Tommy Hilfiger lawsuit explains. This shoe features an open toe, furry footbed and sides, and an elastic heel strap.

The Tommy Hilfiger lawsuit alleges that the Fluff Yeah slides “are one of the most well-recognized and commercially successful styles of Ugg brand footwear products,” and that they have garnered significant unsolicited media attention from celebrities.

Deckers alleges Tommy Hilfiger brand slides are similar to the Fluff Yeah slides and are likely to confuse the public, causing them to believe they are affiliated with the Ugg brand.

Defendant tried to exploit Ugg brand goodwill, Tommy Hilfiger lawsuit alleges

The Tommy Hilfiger lawsuit notes that MBF is a competitor of Deckers and says the company introduced its Laydown fluffy slides in an effort to “exploit Deckers’ goodwill and the reputation of the Ugg Fluff Yeah Slide.”

The Ugg lawsuit asserts claims for trade dress infringement, patent infringement, and unfair competition.

Deckers is seeking injunctive relief to prevent MBF from manufacturing, marketing, and selling products that infringe upon the Ugg Fluff Yeah designs or otherwise giving consumers the false impression that the Tommy Hilfiger slides are associated with Deckers.

Deckers also seeks an award of all of MBF’s profits and damages Deckers sustained due to the defendant’s allegedly wrongful acts.

In 2020, Tommy Hilfiger escaped a class action lawsuit alleging it advertised its clothing products with fake sale prices.
