The Trump campaign has revised a Pennsylvania election lawsuit.

UPDATE: On Nov. 22, 2020, President Donald J. Trump’s re-election campaign might have been dealt a heavy blow in a Pennsylvania court Saturday, but it picked itself back up Sunday and filed an appeal with the 3rd Circuit, signaling its intention to keep challenging the Keystone State’s vote count.


The Trump campaign has filed another revised complaint in federal court over what it says are irregularities Pennsylvania’s election process.

In this third version of the lawsuit, which names the Pennsylvania Secretary of State and several county election boards as defendants, Donald Trump’s campaign contends either the president should be declared the winner of the presidential race in Pennsylvania or the state legislature should be granted the power to assign the state’s electoral votes, according to a Politico report.

The Trump campaign’s revised complaint alleges the defendants’ “egregious misconduct” included ignoring state mandates concerning mail-in ballots — including a mandate dictating postmark deadlines — and preventing campaign representatives and other Republicans from observing “ the receipt, review, opening, and tabulation of mail-in ballots.”

According to Politico, claims that the campaign’s rights were violated when observers were allegedly not being given appropriate access were repeated in this revised lawsuit after being dropped in the first revision.

Rudy Giuliani, an attorney for Trump, said those claims were dropped in a version of the lawsuit filed Sunday due to a miscommunication after lawyers representing the campaign were harassed and threatened, according to Politico.

According to the Trump campaign’s lawsuit, heavily Democratic counties notified voters who had cast mail-in ballots with “deficiencies,” allowing them to cure the ballots via provisional voting on Election Day or by casting a reissued mail-in ballot.

“…Republican-controlled counties followed the law and did not provide a notice and cure process,” the lawsuit alleges.

But the Pennsylvania Supreme Court on Tuesday issued a 5-2 decision that election observers were, in fact, provided with adequate access even if the details of individual ballots couldn’t be seen, Politico reported.

Similar accusations were leveled in a Trump campaign lawsuit in Michigan.

“The evidence is plain that Defendants have blatantly violated the protections and procedures, including those enacted by the Pennsylvania General Assembly, vitally necessary to ensure that the votes of the citizens of Pennsylvania are not illegally diluted by invalid ballots and that the election is free and fair,” the revised Pennsylvania lawsuit alleges.

As of Wednesday night, President-elect Joe Biden was leading by more than 80,000 votes in Pennsylvania, Bloomberg reported.

Boockvar responded to the revised complaint Thursday, saying it was obvious the Trump campaign knew it would not win the state’s popular vote and was just asking the court to declare Trump had won, according to Bloomberg.

During a Thursday press conference, Giuliani stood by his claims of a national conspiracy by Democrats to use voter fraud to steal the election for Biden, Bloomberg reported.

Voters “elected Donald Trump, they didn’t elect Joe Biden,” Giuliani said. “Joe Biden is in the lead because of the fraudulent ballots, the illegal ballots that were produced and were allowed to be used after the election was over. Give us an opportunity to prove it in court, and we will.”

However, Pennsylvania officials say the Trump campaign lacks standing for its lawsuit, according to Bloomberg.

Boockvar said the best option for pursuing the case through court would be for voters who think their ballot may have been improperly rejected to sue their county of residence rather than accusing other counties of constitutional violations.

Missing from the complaint are allegations of widespread voter fraud that Giuliani and Trump each have spoken of publicly, Bloomberg reported. Democrats say no evidence exists of such fraud, and election experts say the Trump campaign is using the litigation as a means of undermining Biden.

The Democratic National Committee (DNC) made its own filing in the case Thursday, pointing out the Trump campaign has no evidence of its claims.

“It has been more than two weeks since election day, and Plaintiffs have yet to offer a scintilla of evidence of any fraudulent conduct or systemic breakdowns that would be required to undo an entire election for every office on the ballot, let alone to reverse President Trump’s 83,000-plus vote deficit in Pennsylvania,” the DNC said, according to Bloomberg.

In terms of relief, with this second revised complaint, the Trump campaign is asking the Court to stop the certification of the general election results, including “the tabulation of absentee and mail-in ballots which Defendants improperly permitted to be cured.”

The Trump campaign also seeks an order or injunction declaring the state’s 2020 presidential general election results are “defective” and allowing Pennsylvania’s General Assembly to choose the state’s electors.

They also seek reasonable court costs and expenses, such as attorneys’ fees, and any other relief the Court might deem just.

    The dems are gonna end up killing and ruling all of our lower class and middle class citizens. If we don’t quit bickering about all of this political bs and really pay attention to alot of higher up people like doctors and nurses, firemen, and just all kinds of people. we really need to get our act together , because the end is coming for a lot of us if we don’t.

      I think the American people should bring this to the highest court. There is more than enough evidence to not only overturn this stolen election but to demand that just justice be served to all involved or aided In this coup. This ILLIGAL act of certain ideological power hungry institutions are bringing the world to certain destruction.
      I would only ask that there be a law passed to hold to account those in certain influential positions that can sway populations, markets, and peoples lives over intentionally lying for any type of gain for self, party, interest or ideology. Punishable by law and financial loss.

    NO!! He can’t handle that he has lost fair and square! He is the result of a spoiled man who daddy taught him that second place is unacceptable. He is asking people of higher authority to reverse the people’s vote in his favor. He is putting the USA in danger by his actions and being a spoiled human being his entire life. This needs to stop ASAP!
