UPDATE: On Nov. 22, 2020, President Donald J. Trump’s re-election campaign might have been dealt a heavy blow in a Pennsylvania court Saturday, but it picked itself back up Sunday and filed an appeal with the 3rd Circuit, signaling its intention to keep challenging the Keystone State’s vote count.
President Donald J. Trump’s legal campaign to contest and block the official certification of Pennsylvania’s election results has changed erratically over the last week – claims were dropped, lawyers left, new lawyers were hired, and revised allegations considered.
The matter was set to come to a head, of sorts, at a hearing Tuesday in federal court in Williamsport.
Trump’s campaign filed numerous individual challenges to components of the election in Pennsylvania before, during, and after Election Day on Nov. 3, but the cornerstone of the effort became a federal lawsuit seeking to prevent the state from certifying its vote count Nov. 23. Last Friday, the law firm leading the charge, withdrew from the case.
Two days later, a local attorney left still handling the case, filed an amended complaint on behalf of the Trump campaign that cut out all specific allegations about the access poll watchers were given to witness vote counting in Philadelphia and elsewhere.
“We are still making the strong argument that 682,479 ballots were counted in secret,” The Washington Post quoted campaign spokesman Tim Murtaugh as saying late Sunday. “Our poll watchers were denied the legal right to meaningful access to vote counting and we still have that claim in our complaint. We have preserved our rights to make these arguments.”
Still, the lawsuit no longer includes formal, individual charges of denied access to Trump poll watchers.
The claims about a lack of meaningful access had been a significant part of the original lawsuit, but a ruling by the U.S. Court of Appeals for the Third Circuit on Friday cast doubt on the likelihood they would succeed.
Over the weekend, Trump directed Rudy Giuliani, his personal attorney, to take over the increasingly unsuccessful legal battles to prevent president-elect Joseph R. Biden from being the certified winner of the race.
On Monday, the Trump campaign moved to replace past lawyers with Giuliani and Marc A. Scaringi, a corporate lawyer and conservative activist from Pennsylvania’s capital, Harrisburg.
U.S. District Judge Matthew W. Brann refused to postpone Tuesday’s hearing to give Scaringi more time to prepare.
The Trump campaign indicated Monday night it intended to file another amended version of its federal complaint replacing the pared down version filed Sunday, according to reporting by The Philadelphia Inquirer.
Giuliani insisted on Twitter on Monday that, despite what was previously filed, Trump concedes on none of his claims.
Tuesday’s hearing on Trump’s lawsuit to block certification of Pennsylvania’s election results is seen as the last serious chance he has to impact the outcome of the election there. Even so, while the lawsuit claims widespread and systemic voter fraud in Pennsylvania, it lacks any detailed allegations and offers no specific evidence of instances of illegality.
The Pennsylvania’s election results case is one of several Trump is pursuing across the country in an attempt to reverse Biden’s victory. Trump’s campaign has been pursuing cases in Michigan, Georgia and Arizona over claims of fraud related to mail-in ballots, ballot counting and election observing.
