Gallup TCPA class action settlement

A settlement has been reached in a class action lawsuit alleging Gallup Inc., formerly known as the Gallup Organization Inc., violated the Telephone Consumer Protection Act (TCPA) by using an automated telephone dialing system to place calls to cell phones without the prior express consent of the recipient of the call. If you received a survey call to your cellular telephone from Gallup, you may be eligible to receive a payment from the TCPA class action settlement.

This Gallup TCPA settlement will resolve three class action lawsuits that were consolidated into one case, titled Soto v. The Gallup Organization Inc. The TCPA protects consumers from unwanted phone calls and text messages. Gallup denies any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the risk and cost of trial.

If approved, the Gallup class action settlement would provide $12 million to pay claims from Class Members, plaintiffs’ attorneys’ fees and costs, incentive awards and costs of settlement administration.

Class Members of the Gallup TCPA settlement should have received a postcard notice in the mail. If you did not receive notice of the class action settlement but you believe you are a Class Member, contact the Settlement Administrator.

UPDATE: On Feb. 1, 2016, our readers confirmed that Class Members who submitted timely and valid claims for the Gallup TCPA settlement began receiving checks worth as much as $32.18.

Who’s Eligible

Under the terms of the Gallup class action settlement, Class Members include: “All persons in the United States who received a survey call from Gallup to a cellular telephone, through the alleged use of an automatic telephone dialing system, from August 16, 2009 through August 16, 2013.”

Potential Award

It is estimated that cash payments will be between $25 and $80 per claim. The actual amount depends on the total number of timely and valid claims submitted by Class Members.

Note: Class Members may make only one claim per cellular telephone number for any calls they received from Gallup during the relevant time period.

Proof of Purchase

N/A. Class Members must provide the cell phone number at which they received calls from Gallup without their prior express consent.
