Nike+ FuelBand

A false advertisement class action lawsuit was filed against Nike Inc. and Apple Inc., alleging these companies violated consumer protection laws and warranty obligations by making misleading statements about their Nike+ FuelBand products.

Plaintiff Caroline Levin filed this Nike+ FuelBand false advertisement class action lawsuit in May 2013, claiming she paid $150 for the Nike and Apple wrist band fitness device under the assumption that the product would track every step taken and every calorie burned by the person wearing the Nike+ FuelBand.

However, contrary to Nike’s advertisement that their FuelBand product accurately tracks calories burned, Levin alleges the product registers inaccurate readings, thus “misleading and damaging customers,” according to the Nike class action lawsuit.

Additionally, the plaintiff claims Nike and/or Apple also failed to honor the warranty for their Nike+ FuelBand fitness product, among other allegations.

Nike and Apple deny all liability in regard to the Nike+ FuelBand false advertisement allegations, but have decided to settle the case in order to avoid the uncertainty and cost of further litigation.

Who’s Eligible

According to the Nike+ FuelBand class action settlement, Class Members include, “All people and entities in the United States who purchased a Nike+ FuelBand from the time period from and including January 19, 2012, through June 17, 2015.”

Potential Award

$15-$25

According to the terms of the Nike+ FuelBand Class Action Settlement, Nike has agreed to give each Class Member $15 or $25 gift card, redeemable at any Nike-owned stores in the U.S. and Puerto Rico and/or online at Nike.com, to compensate for each Nike+ FuelBand purchased by said Class Member during the Class Period if they submit a valid claim form before the deadline.

Proof of Purchase

Class Members must provide the serial number of their Nike+ FuelBand device in order to have their claim processed.
