PreCheck Background Check Class Action Lawsuit Settlement

The healthcare background screening company PreCheck has agreed to pay $1.6 million in order to settle a Fair Credit Reporting Act class action lawsuit.

Lead plaintiff Sarmad Syed accused the background check company of providing consumer reports for job purposes to employers or potential employers without complying with FCRA guidelines.

According to the PreCheck class action lawsuit, the FCRA requires that background check companies first obtain the requisite certification from an employer or prospective employer to whom it provided the consumer report.

The PreCheck class action settlement administrator will contact potential Class Members based on their background check records. Individuals who do not exclude themselves from or opt-out of the background check class action settlement will automatically be considered Class Members eligible for financial compensation.

PreCheck settlement Class Members include individuals who had a consumer report pulled between May 20, 2009 and Sept. 18, 2015 for employment purposes. To be included in the PreCheck class action lawsuit settlement, Class Members must have also listed California as their state of residence at the time the report was furnished.

PreCheck denies all allegations and liability; however, they have agreed to the terms of the class action settlement in order to avoid further litigation costs.

The court has been given notice of the proposed PreCheck background check class action lawsuit settlement but it awaits final approval.

Who’s Eligible

PreCheck settlement Class Members include individuals who had a consumer report regarding employment furnished between May 20, 2009 and Sept. 18, 2015. They also must have listed California as the state of residence.

Class Members should have received a postcard Settlement Notice in the mail based on PreCheck’s records indicating that they qualify to join. Potential Award

$15

PreCheck background check class action settlement Class Members who do not opt-out or exclude themselves will receive a portion of $1.6 million. After expenses, Class Members should receive an estimated $15; however, this amount is subject to change.

Proof of Purchase

N/A. In order to receive a PreCheck settlement payment, Class Members do not have to do anything. Your interest as a Class Member will be represented by the lead plaintiff and Class Counsel.

Claim Form

While there is no Claim Form, potential PreCheck Class Members can either call Class Counsel to make sure they are a part of the FCRA class action lawsuit settlement or object/opt-out by contacting the Settlement Administrator before 12/28/15.

N/A. There is no Claim Form deadline, however the exclusion or opt-out deadline is 12/28/2015.
