Muscle Milk Class Action Settlement Gets Final OK | 2014

A California federal judge has granted final approval to a $5.3 million class action settlement between CytoSport Inc. and customers who purchased the company’s Muscle Milk drinks and nutrition bars between 2007 and 2012.

Over 33,300 Class Members will receive more than $30 each, according to the July 1 approval Order signed by U.S. District Judge Claudia Wilken. Payments will likely be mailed by the end of the summer as long as no objections are filed.

The Muscle Milk settlement resolves a class action lawsuit accusing CytoSport of deceptively marketing its Muscle Milk ready-to-drink beverages and Muscle Milk bars as “healthy.” The Muscle Milk class action claimed that terms like “Healthy Sustained Energy,” “Health Fats,” “Good Carbohydrates,” and “0g Trans Fat” inaccurately portrayed the health benefits of the products in violation of California law.

CytoSport denied the allegations but agreed to the class action lawsuit settlement in March 2013. Judge Wilken preliminarily approved the deal a few months later in November.

Consumers who purchased Muscle Milk drinks and bars at retail between July 18, 2007 and Dec. 31, 2012 had until March 12, 2014 to file a claim to receive up to $30 to $60 in refunds, depending on how many products they purchased.
