CytoSport Muscle Milk Class Action Settlement Money in the Mail | 2014

Close to 33,000 consumers who purchased Muscle Milk products between 2007 and 2012 are receiving checks in the mail as part of a class action lawsuit settlement approved earlier this summer.

Viewers are reporting to TopClassActions.com that the checks are valued at $32.10 and were mailed Sept. 23.

The CytoSport settlement money is from a class action lawsuit filed in 2011 that accused CytoSport Inc. of deceptively advertising the nutritional value of its Muscle Milk Ready-to-Drink beverages and Muscle Milk bars.

Plaintiff Claire Delacruz alleged in the Muscle Milk class action lawsuit that label statements such as “Healthy Sustained Energy,” “Health Fats,” “Good Carbohydrates,” and “0g Trans Fat” inaccurately portrayed the health benefits of the products in violation of California law.

CytoSport denied the allegations but agreed to a $5.3 million class action lawsuit settlement in March 2013. A total sum of $1 million was made available to consumers who purchased eligible products between July 18, 2007 and Dec. 31, 2012. Class Members could claim a pro rata share of the Muscle Milk settlement based on how many products they purchased. The deadline to file a claim was March 12, 2014. U.S. District Judge Claudia Wilken granted final approval to the deal on July 1.
