A proposed settlement has been reached in a class action lawsuit alleging Lott Restaurants LLC d/b/a McDonald’s violated Illinois and federal wage and hour laws. If you worked at any McDonald’s restaurant located within O’Hare International Airport at any time from December 2009 through Dec. 1, 2015, you may be entitled to a cash payment from this class action settlement.
Three former McDonald’s employees filed the wage and hour class action lawsuit against Lott Management Inc., Lott Restaurants LLC, Lott #1 Inc., Derrick Lott and Christine Lott for alleged violations of the Fair Labor Standards Act, the Illinois Minimum Wage Law and the Illinois Wage Payment and Collection Act.
According to the McDonalds class action lawsuit, Lott failed to pay employees for the time they spent performing work before the start time or after the end time of their scheduled shifts. Further, the plaintiffs allege Lott failed to pay employees for any work performed while they were supposed to be on their meal breaks.
The Lott defendants deny any wrongdoing and maintains that their pay practices didn’t violate the FLSA, the IMWL, the IWPCA or any other state or federal laws. However, they have agreed to settle the McDonald’s wage and hour class action lawsuit to avoid the expense and uncertainty of ongoing litigation.
Who’s Eligible
Class Members of the McDonald’s wage and hour settlement include all individuals who were employed by the Lott Defendants, their subsidiaries, predecessors or affiliated companies as crew members or other hourly employees at any one of the five Lott McDonald’s restaurants located within O’Hare International Airport at any time between December 2009 and Dec. 1, 2015.

Individual payments will depend on the number of weeks each Class Member worked during the Class Period, the total number of work weeks all participating Class Members worked during the Class Period, and the total number of Claim Forms that are submitted.
The exact amount each Class Member will receive is not yet known. It is estimated that a typical Class Member who worked for Lott for a full year could receive a payment between $237.46 and $470.20.
