Decking and railing manufacturer Louisiana-Pacific Corp. is still accepting claims for a class action settlement regarding alleged defects in its products. If you own an ABTCo., Veranda or WeatherBest decking or railing product, you may be eligible to submit a Claim Form to request an inspection of your decking/railing and obtain settlement benefits.
Who’s Eligible
Owners of an ABTCo., LP, Veranda or Weatherbest decking or railing product are eligible to file a claim any time before their original warranty expires if they experience deterioration or other damage.
Potential Award
Varies. If your deck or railing has any deterioration as defined by the class action settlement, LP will repalce the deck at no charge to you. If your deck or railing is damaged as defined by the settlement, you will be offered a cash payment of $3.78 per linear foot for the damaged deck material (less a “reasonable use” deduction of 10% per year) or $1.78 for each $2,00 of material cost paid for the railing damage.
Proof of Purchase
Not required. However, you will have to submit a claim to schedule an inspection of your decking or railing.
Claim Form Deadline
The deadline to file a claim for all Class Members will end at the expiration of the Class Member’s warranty for the product.
Case Name
Carol Postier, et al v. Louisiana-Pacific Corporation, Case No. C09-3290 JCS, in the U.S. District Court for the Northern District of California.
Case Summary
The LP Decking settlement resolves a class action lawsuit filed by Carol Postier against Louisiana-Pacific Corp., alleging that the defendant manufactured, warranted and sold certain LP composite decking and railing materials that are subject to premature deterioration.
The defendant denies the allegations but both parties reached a class action settlement in September 2010 to resolve the class action lawsuit. Even though the settlement was reached several years ago, owners of an ABTCo., LP, Veranda or Weatherbest decking or railing product are eligible to file a claim any time before their original warranty expires.
A Claim Form must be submitted in order to qualify for a monetary payment or decking/railing replacement. The deadline to file a claim for all Class Members will end at the expiration of the Class Member’s warranty for the product. According to the Settlement Notice, all applicable decking/railings are subject to a 10-year warranty, with the exception of the Veranda brand decking/railing, which carries a 15-year warranty. The Claim Form must be postmarked within the warranty period applicable to the product to be considered valid.
If you have any deterioration in your deck as defined by the class action settlement, LP will replace it at no charge. You will be offered a cash payment if your deck is damaged as defined by the settlement but does not present a risk of structural failure. All of these settlement benefits are described in detail in the LP Decking & Railing Class Action Settlement Notice.
