Great Western Bank has reached a class action lawsuit settlement over allegations it charged improper overdraft fees. If you were charged an overdraft fee from Great Western Bank between 2000 and 2010, you may be eligible to receive a cash payment from the class action lawsuit settlement.
The settlement will resolve allegations that Great Western Bank posted debit card transactions from highest to lowest dollar amounts in order to maximize the number of overdraft fees it assessed customers. Great Western Bank denies the allegations but has agreed to pay $2.2 million to settle its portion of the massive consolidated class action lawsuit, In Re: Checking Account Overdraft Litigation, in which 30 other U.S. banks are accused of the same improper practices. Â
Class Members of the Great Western Bank overdraft class action settlement include all current and former checking account customers that could access their accounts with a debit card and incurred an overdraft fee at any time between June 15, 2004 and August 13, 2010, except for those members of the Settlement Class with an account that was opened in Iowa, in which case the period is June 15, 2000 through August 13, 2010.
Class Members who opened their accounts prior to February 1, 2007 must submit a valid Claim Form in order to receive a payment. The deadline to submit a Claim Form is July 16, 2013. All other Class Members will automatically receive a cash award or account credit.
Payments or account credits will be sent only after the Court grants Final Approval of the Settlement and any appeals are resolved. The Final Approval Hearing is set for June 26, 2013.
