A settlement has been reached in a class action lawsuit alleging that Alltel Corporation improperly charged early termination fees to some of its customers. If you paid an early termination fee (ETF) to Alltel, you could be eligible for benefits from the class action settlement.
Plaintiff Peter Rosenow filed the Alltell class action lawsuit in 2006, alleging he was improperly charged a $200 early termination fee after he cancelled his Alltel service. He claims he did not sign any contract that would impose the ETF, and that Alltel refused to provide him with copies of the contract so that he could view the terms that justified the ETF. Further, Rosenow alleges the ETF imposed by Alltel is excessive and is not related to any actual damage Alltel may suffer when a customer cancels the service.
The Alltel ETF class action lawsuit alleged Alltel’s early termination fee violated the Arkansas Deceptive Trade Practices Act and resulted in unjust enrichment by Alltel. Alltel denies any wrongdoing but has agreed to issue refunds to some of its customers under the terms of the class action settlement.
Who’s Eligible
Class Members include Arkansas residents who paid Alltel’s early termination fee from Feb. 15, 2001 through Nov. 10, 2014. Alltel’s employees, officers, directors and agents are excluded from the class action settlement.
Potential Award
$70 per line on which an Early Termination Fee or Early Disconnect Penalty was paid between Feb. 15, 2001 and Nov. 10, 2014 by customers whose billing address was in the State of Arkansas.
Proof of Purchase
Class Members must submit a valid Claim Form affirming each of the following:
- You held an account with Alltel and can provide your Alltel mobile telephone number;
- Between Feb. 15, 2001 and Nov. 10, 2014, you paid one or more Early Termination Fee or Early Disconnect Penalties charged by Alltel; and
- At the time you paid the ETF(s), your billing address was within the state of Arkansas.

Same situationin Mississippi. I remember getting something in the mail years later about the class action lawsuit. I was naive about what settlements were and threw it away. I was young and dumb.
I paid $200 in 2006 or 2007 for early termination.

Got a post card rejecting my claim because it says my phone # was not in the state of arkansas. Hey you idiot lawyers. Just because the phone # does NOT have an Arkansas area code doesn’t mean I was not in arkansas and lived there and used the phone there. I live an another state now and have an area code out of California, and I am 2000 miles from there.
