Werner Co. has agreed to settle a class action lawsuit involving allegations that it made and marketed steel attic ladders with defective parts. If you currently own a steel “Easy Access Attic Ladder” in model numbers S2208 and S2210, Marks 1, 2, 3 or 4, you may be eligible to receive a new Werner wood or aluminum attic ladder from the class action settlement.
Who’s Eligible
Class Members of the Werner attic ladder class action settlement include all individuals or entities in the United States who currently own a Werner Model S2208 or S2210 steel attic ladder designated as Marks 1, 2, 3 or 4.

Proof of Purchase
Required. You must submit a receipt or other proof of purchase showing you purchased a Werner S2208 or S2210 attic ladder with a date of purchase between September 2003 and September 2005; OR the label affixed to the inside portion of the wooden door of my Werner S2208 or S2210 attic ladder. The label must show “Mk 1,” “Mk 2,” “Mk 3,” or “Mk 4” immediately below “S2208” or “S2210.”

Case Summary
If approved, the Werner attic ladder settlement will resolve a class action lawsuit (Clemans v. New Werner Co.) that alleges Werner made and marketed a steel “Easy Access Attic Ladder” with defective zinc hinges that are prone to breaking and shearing while the ladders are being used.
Werner has denied the allegations but agreed to settle the class action lawsuit to avoid the expense and risk of trial.

Right side hinge broke while going up steps. Surprisingly I did not get hurt. Really need a replacement part. Can not find anywhere. Can you help?

Left lower pivot just broke as I was heading up to the attic, no injury but sure did startle me. Looking for parts and found out about the class action suit. We had some small roof leaks recently and need to bring everything stored up there down and now my ladder is broke, great timing. S2208 mk2. Tried calling and just got stuck in the dreaded press 1, 2,3,or 4 loop. Will try calling again but it sounds like there’s not much they’ll do.
I hurt my self on broken hinge on Werner s2200 attic stair way ladder recently. I did not get a notice about this issue with the stair and perhaps it would of saved me hurting myself . As a result I just found out about the class action suit which indicates a replacement for all that have such units installed. Please let me know how to get a alum replace attic ladder for the defective one installed.

My wife and I experienced the same – the lower right hinge broke as I was climbing the ladder to access my attic. We received no notice or warning regarding this defective product from Werner or public safety notice. We discovered the product was defective and that a Class Action Suit had been filed and closed – no other claims accepted. The Customer Service Representative was very nice. I was told the claimed submission had been closed for sometime, but Werner was offering a Home Depot $50 gift card toward purchase of replacement ladder. I received an email from the Customer Service Representative; followed the enclosed instructions and replied with attachments requested. Hopefully the processing of my submission will be as quick as possible.
