Hyundai Motor America has agreed to settle a class action lawsuit alleging it violated the laws of several states by recording or monitoring telephone calls without providing notice to or getting consent from callers. If you made a phone call to a toll-free Hyundai customer assistance telephone number between Aug. 17, 2011 and Nov. 29, 2011, you may be eligible for benefits from the class action settlement.
According to the call recording class action lawsuit, Hyundai recorded and/or monitored calls to its customer service lines without first obtaining consent from the callers. Plaintiff Brandon Wheelock alleges that during the period from Aug. 17, 2011 and Nov. 29, 2011, Hyundai “intentionally and surreptitiously recorded and/or monitored these calls … between Hyundai customers and employees without ever warning customers they were being recorded and/or monitored and without ever obtaining customer consent or permission.”
The Hyundai call recording class action lawsuit alleged this practice of recording and/or monitoring calls without the consent of the callers violated the laws of California, Florida, Maryland, Nevada and New Hampshire.
Hyundai does not admit wrongdoing, but it has agreed to settle the call recording class action lawsuit to avoid the cost and uncertainty of a trial. Under the terms of the class action settlement, Hyundai will pay a total of $1.35 million to resolve the litigation.
UPDATE: On Feb. 21, 2016, according to reader comments and posts on the Top Class Actions Facebook page, Class Members who submitted timely and valid claims for the Hyundai call recording class action settlement began receiving checks worth as much as $427.88.

Class Members of the Hyundai call recording settlement include residents of California, Florida, Maryland, Nevada or New Hampshire and called one or more of the following toll-free customer assistance telephone numbers and spoke with a representative of Hyundai between Aug. 17, 2011 and Nov. 29, 2011:

Potential Award
Up to $5,000. However, the actual amount each Class Member will receive depends on the number of timely and valid claims that are filed. If all eligible Class Members file claims for the Hyundai call recording class action settlement, they will receive a payment of $68.16 each.
