Toyota Tundras overview:

A new class action lawsuit accuses Toyota of selling Tundra trucks with a dangerous engine defect that causes stalling, delayed acceleration and even catastrophic failure.

Plaintiffs Tom Daley, Marty Holstien and Terrance Regan filed the class action complaint against Toyota Motor North America Inc. on Dec. 2 in a Vermont federal court, alleging violations of state and federal consumer laws. 

According to the lawsuit, certain Toyota Tundras have a defect in the V35A engines that traps debris inside the engine. Drivers report “throttle lag,” “jolting,” or “lurching” when the defect occurs, where pressing the gas pedal produces no immediate response, followed by a sudden burst of acceleration, the lawsuit says.

These conditions create a serious safety risk on the road, including potential rear-end collisions and unexpected surges at stoplights, the plaintiffs say. Some vehicles have also reportedly suffered complete engine failure, leaving drivers stranded.

The defect, plaintiffs allege, exposes consumers to not only physical danger but also financial harm due to repair costs and diminished vehicle value.

Lawsuit alleges that Toyota Tundras recall falls short

Toyota issued a recall in May 2024 for certain 2022 and 2023 Tundras, acknowledging the risk of crashes from engine stalls. However, the lawsuit criticizes the recall as insufficient, claiming it excludes the 2024 Tundra and hybrid models, which allegedly experience similar issues. 

The plaintiffs allege that Toyota’s justification for excluding hybrids — that their powertrain offers limited backup power — is inadequate.

The company also informed affected owners via a recall notice that it is “currently developing the remedy” for the problem.

However, the lawsuit says, “Plaintiffs and class members are currently stuck driving a vehicle that Toyota knows is dangerous, but has no concrete timetable for a workable fix.”

As a result, the plaintiffs are looking to represent owners and lessees of 2022-2024 Tundra and Tundra hybrid vehicles.

They are suing for violations of warranty laws, consumer fraud, and violations of state consumer laws. They are seeking certification of the class action, damages, fees, costs and a jury trial.

In November, Toyota was hit with a class action lawsuit alleging it breached its manufacture warranties by selling certain vehicles with a door-lock defect.

    I don’t have a tundra but I have a 2023 Toyota Camry purchased brand new and it makes a loud pop noise sounds like it’s over my head but I’m not sure!

    Yes I have a 2022 limited edition trd pro that they recalled the engine. Well they said it would void my warranty if I did not r see place my engine. My truck ran perfect before they replaced my engine. Now my twin turbo don’t work properly and I don’t have near the horse power. I use to have had it back at the dealership twice and they say everything fine. I just want my engine back .Ronnie Hubbard.

    Yes I have this problem in my 2012 Toyota Tundra! It makes it very unsafe to drive with huge repair bills!

    I have 24 Tundra just at 19k miles and the engine seized up 2 days after I made my appointment for the 20k mile oil chang . Its been sitting at the dealership since May 24thits now July 18th nothing has been done .

    I have a 2022 Tundra with repeated engine failures. The first engine blew at 32K miles, and Toyota of Palm Beach, FL took 3 months to fix it. After 6K more miles, throttle lag and stalling occurred, and they said the engine had failed again—this repair took 2 months. After picking up the truck with warning lights, I had the codes cleared, but the check engine light returned, and following a short 7-mile drive, the engine blew once more. This is now my fourth engine failure. What can I do?

    I have had this same issue where I have almost been slammed into getting into traffic on a country road. We have some of these trucks in our company and they have reported the same thing… some employees will not drive them. I am the only one with the hybrid and its literally one of the scariest things in the world seeing a car come at you and you cant get your truck moving.

    I bought a 2024 Toyota tundra sr5 back in Nov 2023 at Mike Shaw Toyota in robstown with 5 miles on it and it has had issue after issue and the dealerships will not help me I have taken it to classic Toyota in Galveston multiple times cause this issue my engine had shut off while driving may 2024 said engine reduced power and it shut down Oct 2024 again while driving and said engine shut down Dec 2 my cruise control system stopped working while driving I had to turn my truck off and back on for it to work again and again this Friday 18th 2025 | was driving to work and my engine shut off while I was on the highway it’s under warranty and I keep getting the runaround they keep saying they can’t find anything but something is wrong if someone can call me please that would be great my truck should be getting fixed and no one will help me with my truck and it’s clearly under warranty

    I bought a 2022 Toyota tundra limited and every time I drive it I’m scared that something going to happen or be in a accident from the engine problem my truck hesitate and jerk while driving and I’m really hoping a solution come soon
