Target marinara class action lawsuit overview: 

  • Who: Jennifer Carbine filed a class action lawsuit against Target Corporation.
  • Why: Carbine claims Target falsely advertises that its Good and Gather Pasta Sauce products are free from artificial preservatives when, in reality, the products contain the artificial preservative citric acid. 
  • Where: The Target preservatives class action lawsuit was filed in California federal court. 

Target Corp. falsely advertises that its Good and Gather Pasta Sauce products are free from artificial preservatives, a new class action lawsuit alleges. 

Plaintiff Jennifer Carbine’s Target class action lawsuit claims the marinara sauce, in reality, contains a synthetic form of citric acid that is “derived from heavy chemical chemical processing.”

Carbine argues she would not have purchased or would not have been willing to pay as much for Target’s marinara product had it not been for the company’s “misconduct.”  

“Plaintiff would not have purchased the Products, or would have paid less for the Products, had she known that the products actually contain an artificial preservative ingredient,” the Target marinara class action says. 

Carbine wants to represent a class of consumers who bought Target’s Good and Gather Pasta Sauce products in California for personal use within the applicable statute of limitations.  

Target marina not really a ‘premium product,’ class action claims 

Carbine argues Target is intentionally deceiving consumers by falsely labeling that its Good and Gather Pasta Sauce products have “No Artificial Colors, Flavors, or Preservatives.” 

“Defendant’s packaging, labeling, and advertising scheme is intended to give consumers the impression that they are buying a premium product that is free from preservatives,” the Target preservatives class action says. 

Carbine claims Target is guilty of breach of express warranty and violating California’s Unfair Competition Law and Consumers Legal Remedies Act

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of actual damages for herself and all class members. 

A consumer filed a similar class action lawsuit against Target last year over claims the company falsely advertised that its Market Pantry branded berry pomegranate flavored water enhancer contained only natural flavors.
