Online shoe retailer Stride Rite engages in aggressive unsolicited marketing to promote its shoes, harming thousands of consumers in the process, a new class action lawsuit alleges.

Plaintiff Adina Ringler filed the class action lawsuit against Vida Shoes International Inc. (Stride Rite) on March 20 in a California federal court, alleging violations of the Telephone Consumer Protection Act (TCPA).

According to the plaintiff, beginning on Feb. 2, 2021 and continuing through Dec. 12, 2022, Stride Rite “bombarded” Ringler with telemarketing text messages to her cellphone.

Stride Rite did not provide any instructions in the texts on how to opt-out of future text messages by, for example, advising them that they could text “Stop” to get the messages to stop, which is a standard requirement, Ringler says.

“At no point in time did Plaintiff provide Defendant with her express written consent to be contacted,” the lawsuit states.

Incessant text messages caused people harm, lawsuit alleges

Stride Rite’s unsolicited text messages caused Ringler actual harm, including invasion of her privacy, aggravation, annoyance, intrusion on seclusion, trespass, and conversion,” the lawsuit states. 

The text messages also inconvenienced Ringler and caused disruption to her daily life and the lives of others.

As a result, Ringler seeks to represent two nationwide classes of people: One class of people who are on the National Do Not Call Registry and received messages from the shoe company, and another who received two or more messages from the company within 12 months.

Ringler seeks certification of the class action, damages, fees, costs and an injunction preventing the company from its alleged illegal conduct.
