Liberty Mutual calls class action lawsuit overview: 

  • Who: Jeffrey Scott filed a class action lawsuit against Liberty Mutual Insurance Company.
  • Why: Scott claims Liberty Mutual makes unsolicited telemarketing calls to numbers that are listed on the National Do Not Call Registry.
  • Where: The class action lawsuit was filed in Massachusetts federal court.

Liberty Mutual breaks the law by allegedly placing unsolicited telemarketing calls to consumers who have their numbers listed on the National Do Not Call Registry, a new class action lawsuit alleges. 

Plaintiff Jeffrey Scott claims Liberty Mutual contacted his cell phone — which has its number listed on the National Do Not Call Registry —  in an attempt to sell him an insurance policy that he “did not want or need.” 

Scott argues that he neither provided consent nor had an established business relationship with Liberty Mutual prior to the company allegedly contacting him with eight telemarketing calls and one text message. 

“As a result of the foregoing, Plaintiff experienced frustration, annoyance, irritation and a sense that his privacy has been invaded by Defendant,” the Liberty Mutual class action alleges. 

Scott wants to represent a nationwide class of individuals who received two or more solicitation calls from Liberty Mutuals within a 12-month period to a number that was listed on the National Do Not Call Registry for at least 31 days.

Liberty Mutual directly liable for alleged unsolicited telemarketing calls, says class action

Scott claims Liberty Mutual is directly liable for the alleged unsolicited telemarketing calls and texts since they were “placed or made directly by Liberty Mutual.” 

Alternatively, Liberty Mutual would be vicariously liable for any unsolicited telemarketing calls or texts in the event that some or all of them were made by third parties on its behalf, the Liberty Mutual class action alleges. 

“To the extent any call was made by a third-party agent acting on Liberty Mutual’s behalf, Liberty Mutual is vicariously liable as it encouraged and benefitted from its agents’ violative conduct,” the Liberty Mutual class action states. 

Scott claims Liberty Mutual violated the Telephone Consumer Protection Act (TCPA). He is demanding a jury trial and requesting declaratory relief along with an award of statutory and treble damages for himself and all class members. 

A similar class action lawsuit was filed last month against Margaritaville Enterprises by a consumer arguing the hospitality company violated the TCPA by allegedly sending unsolicited telemarketing messages to their number listed on the National Do Not Call Registry.

    After just looking up insurance companies my phone was inundated with emails, phone calls, even after putting blocks on my emails I still received them. I received prerecorded voicemails so I couldn’t even tell them to stop calling during those calls.

    I filed a claim back in 2018 on my Home owner insurance and I have been given the run around every since. Never satisfied the payment. My Chimney has been leaking for years and Nothing was Done. The change people everytime and never finish the job. Then sends a Redacted Report.
