Consumers who were contacted about a PACE loan without ever giving their consent to receive it could be eligible to pursue lawsuits. The Telephone Consumer Protection Act is one of the most important laws for consumers in the United States who have been targeted with unwanted phone calls. Many companies have been accused of overstepping the bounds of the TCPA in their telemarketing efforts.

The most recent claims of TCPA violations have to do with offers of a PACE loan. In some cases, consumers might have been contacted about this loan offer without requesting this information or after requesting to be removed from marketing lists.

If a company did not get the consent of the consumer before making these calls, such marketing actions could constitute a TCPA violation.

What is the PACE Program?

PACE stands for Property Assessed Clean Energy Programs. This model is a new mechanism for making renewable energy improvements on a person’s private property.

PACE Programs exist for both residential and commercial properties and allow a person to finance the upfront cost of eligible energy improvements on a property by paying back those costs over time through an assessment.

What Makes This a Loan?

Clean energy projects that are managed through the PACE loan Program are frequently connected to a land secured financing district. This means that a local government issues bonds to fund projects that have a public purpose like a sewer system or a streetlight. However, this program has expanded to individual property owners as well.

How Does the PACE Program Work for a Private Property Owner?

Property owners attempting to make eligible improvements voluntarily choose to participate in this program by paying back their improvement costs over 10 to 20 years through property assessments. These are attached to the individual property owner’s property tax bills.

What Makes A Phone Call Unwanted?

A phone call received about the PACE Program might be relevant to you if you have requested this information.

However, if you have been contacted repeatedly by someone offering you the opportunity to participate in the PACE Program and have requested that your information be removed from their telemarketing lists, or are receiving pre-recorded phone calls with an artificial voice, you could be eligible to pursue compensation under the Telephone Consumer Protection Act.

This law exists to enable consumers to take legal action when they have the victim of telemarketing efforts by companies that are attempting to skirt the law. Many of these companies are counting on consumers not to be familiar with the various aspects of the Telephone Consumer Protection Act.

Should You Take Legal Action After an Unwanted Call About PACE?

Understanding your individual rights and whether or not the company has crossed the line is important.

Keeping an accurate record of all phone calls received about the PACE loan program could help you to present this information to an attorney and to discuss the specifics of your case. If you need assistance with deciding whether or not your case involves a violation or multiple violations of the TCPA, Top Class Actions can help you to find a potential attorney to help you with your claim.
