Plaintiff Cheri Aul claims David’s Bridal continues sending texts even after consumers opt out of receiving them, WESH 2 News reports.
“Sometimes, I just get overly irritated by certain things and this just seems absurd,” Aul told WESH 2 News.
Aul claims she started receiving unsolicited texts from David’s Bridal, which she says she has never shopped at, after she got a new phone number, WESH 2 News reports.
Unwanted Text Messages Continued Even After Opting Out
Despite alleging she opted out of receiving the texts by messaging David’s Bridal back with the word “STOP,” Aul claims she continued receiving the unwanted texts.
“It’s just mind-boggling to think the mechanism they put in place to do what I tried doesn’t do that,” Aul told WESH 2 News.
Aul claims she even received confirmation that she had been unsubscribed from receiving further text messages, which turned out not to be true.
David’s Bridal is attempting to get the class action lawsuit dismissed, arguing that a new Florida law meant to increase regulation on telemarketing is unconstitutional, WESH 2 News reports.
The law in question prohibits telemarketers from using an automatic dialing device to text or call consumers without first obtaining written permission, WESH 2 News reports
A similar class action lawsuit was filed against Rocket Mortgage last month by a consumer who argues the company continued to send unwanted texts and calls to his cell phone even after he asked them to stop.
The plaintiff in that case, Dustin Shirley, claims his number was even on the National Do Not Call Registry, which in itself should have kept Rocket Mortgage from being able to contact him with unsolicited advertising messages.
