Amazon texts class action lawsuit overview:

- Why: Holt claims Amazon violated the Telephone Consumer Protection Act by allegedly sending unsolicited text marketing messages to consumers even after they requested to opt out of receiving them.
- Where: The class action lawsuit was filed in Oklahoma federal court.
Amazon engages in unsolicited text messaging to promote its goods and services, including to consumers who have already chosen to opt out of receiving the messages, a new class action lawsuit alleges.
Plaintiff Jennifer Holt claims unsolicited text messages sent by Amazon violated her statutory rights and caused her to suffer harm in the form of annoyance, nuisance, invasion of privacy and intrusion upon seclusion.
Holt argues Amazon’s allegedly unsolicited text messages also took up storage space on her phone that she otherwise would have had.
“Plaintiff attempted to opt-out of Defendant’s text message solicitations by responding ‘stop’ numerous times, but Defendant continued to text message Plaintiff,” the Amazon class action states.
Holt wants to represent a nationwide class of consumers who have received two or more text messages within a 12-month period soliciting Amazon property, goods or services within the past four years.
Amazon failed to train telemarketers, maintain written policies required by TCPA, class action says
Holt claims Amazon violated the Telephone Consumer Protection Act (TCPA) by allegedly sending the unsolicited text messages to consumers who had already attempted to opt out of receiving them.
Further, Holt argues, Amazon violated the TCPA by allegedly failing to maintain required written policies, provide training to its telemarketing personnel and maintain a standalone do-not-call list.
“Plaintiff is, and at all times relevant hereto was, an individual and a called party under the TCPA in that Plaintiff was the regular user of cellular telephone number that received Defendant’s unwanted text messages,” the class action states.
Holt is demanding a jury trial and requesting declaratory and injunctive relief along with an award of statutory damages for herself and all class members.
Several class action lawsuits have recently been filed or resulted in settlements over claims against companies accused of violating the TCPA by allegedly sending unsolicited text messages or calls without consent.

I was a prime member for years. I thought that if I cancelled prime the texts and emails would end. It did not. I requested texts NOT be sent. They have not. I’m wondering if uninstalling the app would work but I still use Amazon from time to time. At loss.

I had a huge problem with this. Not only by phone calls but also by email. I hadnt asked for these calls and made sure to follow the appropriate guidelines to get them to cease. It didn’t for months! And picked up again out of nowhere for another period of about 4 weeks just recently. I am a PRIME member but my bills are paid and have definitely considered cutting ties w Amazon as they seem to be getting less professional by the day. Please add me.
