A $4.25 million settlement is poised to resolve class action claims that Raymour & Flanigan sent unlawful spam texts to consumers.

The settlement, which has preliminary approval but is still waiting on final approval, will benefit individuals who gave their information to the company and received unsolicited telemarketing texts message from Raymour & Flanigan between Feb. 2, 2016 and March 22, 2017.

Plaintiff Scott Borecki filed his class action lawsuit against Raymour & Flanigan in February 2017, claiming that he and other consumers received telemarketing text messages from the company.

Borecki says he bought bedroom furniture from the store in December 2013 and provided his number for delivery purposes during his purchase. His furniture was delivered and he assumed that the matter was resolved.

However, in November 2016, Borecki allegedly received a spam text advertising sales at Raymour & Flanigan. Several other texts followed, leaving Borecki confused and annoyed.

Although he provided his number to Raymour & Flanigan while purchasing furniture, this was for delivery purposes only. He claims that he never gave express written consent to receive advertisements through text message from the furniture store.

Borecki argues that these texts are a violation of the Telephone Consumer Protection Act (TCPA).

The TCPA protects consumers from harassing communications from businesses. Although many individuals only associate the TCPA with robocalls, the law also prevents unsolicited telemarketing text messages and junk faxes.

Raymour & Flanigan do not admit any wrongdoing by settling the TCPA class action lawsuit against them. Instead, the settlement provides an option for all parties to resolve the claims without the risk and cost of continuing litigation.

Class Members who file a valid claim by June 22, 2019 are estimated receive between $10 and $100. Proof is not required to submit a claim and receive payment from the Raymour & Flanigan settlement.

The deadline for exclusion or objection is June 22, 2019. The final approval hearing is scheduled for Sept. 10, 2019.

Who’s Eligible

Individuals who received telemarketing text messages promoting Raymour & Flanigan’s products and services between Feb. 2, 2016 and March 22, 2017.

Potential Award

$10 – $100 (estimate)

Proof of Purchase

Class Members must provide the phone number which received a text from Raymour & Flanigan.
