A $2.67 million class action settlement has been reached over allegations that U.S. Bank placed unwanted calls and texts to consumers about mortgages and/or home equity loans.
Class Members include those who received a call or text from U.S. Bank about a residential mortgage or home equity loan on their cell phone. The calls or texts must have been for non-emergency purposes and dialed using an automatic dialing system or left a prerecorded message. The contact must have been made between Feb. 19, 2015 and Dec. 31, 2017.
A class action lawsuit accused U.S. Bank of violating federal law when it contacted thousands of cell phone numbers about mortgage and home equity accounts from 2015 to 2017. The U.S. Bank class action lawsuit alleged that the calls and texts were made without the prior express permission of the consumers.
U.S. Bank violated the federal law known as the TCPA or Telephone Consumer Protection Act, according to the class action lawsuit. The TCPA was enacted by Congress to limit the amount of annoying advertising calls and texts received by consumers.
Under the TCPA, companies like U.S. Bank are prohibited from contacting consumers with advertising messages on their phone without their prior express permission. Further, the use of automatic dialing systems and prerecorded advertising messages are limited under the law.
According to the U.S. Bank TCPA class action lawsuit, the financial institution violated several parts of the law. The bank allegedly failed to obtain prior express permission to contact the consumers. Further, the plaintiffs contended there was evidence it had used an automatic dialing system and prerecorded messages.
U.S. Bank agreed to pay $2.67 million to exit the class action lawsuit. Class Members can expect to receive a portion of this award if they submit a timely and valid claim. The amount each Class Members receives depends on the number of claims made before the June 13, 2019 deadline, but is expected to be between $40 and $80.
Class Members can make up to two claims — one for a U.S. Bank call or text they received about a home mortgage and one for a call or text about a home equity loan.
Claims can be submitted online, by phone, or by mail. To make a claim, Class Members must provide their claim ID number or phone number.
The deadline for Class Members to object to or opt out of the U.S. Bank TCPA class action settlement is June 13, 2019.
Who’s Eligible
Class Members include “all users or subscribers to a wireless or cellular service within the United States who used or subscribed to a telephone number to which U.S. Bank made or initiated one or more calls or texts using an automatic telephone dialing system or artificial or prerecorded voice technology, according to U.S. Bank’s available records, regarding: (1) a Residential Mortgage Loan from August 7, 2014 to December 31, 2017 (‘Subclass One’); or (2) a Home Equity Loan from February 19, 2015 to December 31, 2017 (‘Subclass Two’).”

I never received a check. I submitted my claim form on 04/08/19.
Can we cash this check? I saw someone post the check came back with insufficient funds. There are no US Banks near me.
