Texas robocall lawsuit overview: 

  • Who: John Caldwell Spiller II and Jakob Mears were given a judgment of nearly $245 million to resolve claims brought by attorneys general from Ohio, Texas, North Carolina, Missouri, Michigan, North Dakota, Indiana and Arkansas.
  • Why: The attorneys general accused Spiller and Mears of violating state and federal consumer protection laws by allegedly running an unlawful robocall scheme out of Texas. 
  • Where: The lawsuit was filed in Texas federal court. 

A Texas judge has ordered a pair of business partners to pay nearly $245 million over claims they and their companies violated state and federal consumer protection laws by operating an allegedly unlawful massive robocall campaign. 

John Caldwell Spiller II and his business partner, Jakob Mears, were accused by several state attorneys general of breaking the law with their robocall campaign for extended car warranties and health care services, Law360 reports. 

The duo was ordered to pay a total of $244.7 million by a federal judge in Texas on Monday, resolving claims brought against the pair by state attorneys general in Ohio, Texas, North Carolina, Missouri, Michigan, North Dakota, Indiana and Arkansas. 

In addition to the monetary fines — which will be mostly suspended — the Spiller and Mears were also permanently barred from placing robocalls going forward, and from associating with any companies that make robocalls or engage in telemarketing, Law360 reports. 

The judge reportedly also cited the fact that Spiller and Mears — who, as part of the deal, did not admit to any of the allegations made against them — would be unable to pay such a heavy fine amount. 

Attorneys general accused Texas robocall operators of violating TCPA

Spiller and Mears, the owners of Texas-based Rising Eagle Capital Group LLC and JSquared Telecom LLC, were first accused by the attorneys general in 2020 of violating the Telephone Consumer Protection Act (TCPA), Law360 reports. 

The attorneys general reportedly claimed Spiller and Mears violated the TCPA by allegedly sending billions of prerecorded messages to consumers’ landlines and cell phones from the time period of at least June 2018 to early 2020. 

The attorneys general alleged millions of the robocalls were also placed to consumers who had their phone numbers listed on the National Do Not Call Registry, Law360 reports. 

The attorneys general from every U.S. state launched a robocall task force in August 2022 that was created to investigate and prosecute telecom companies allowing foreign robocalls into the country.

    Yes I received unsolicited phone calls every day from healthcare actors long actors as well as credit repair actors and I always ask them to place me on the do not call list and then they end up calling from a different number. This is illegal and I wish there was some way that I could receive monetary compensation from these lawsuits because they call at all types of hours early morning and late at night even past 9:00 and 10:00 sometimes.
