Women who were inmates at the ​​New Jersey Department of Corrections’ (NJDOC) Edna Mahan Correctional Facility for Women since 2014 may be eligible to benefit from a $7,985,600 class action settlement resolving alleged abuses at the facility.

The Class is made up of anyone who is or was, at any time since Jan. 1, 2014, a woman inmate in the custody of the NJDOC who was assigned to Edna Mahan Correctional Facility for Women in Union Township, New Jersey.

Plaintiffs in class action lawsuits alleged female prisoners at Edna Mahan Correctional Facility were subjected to a pattern of sexual abuse and harassment by staff and that NJDOC administrators failed to prevent or remedy this conduct.

In June 2021, the New Jersey governor announced he intended to close Edna Mahan Correctional Facility for Women and relocate its nearly 400 inmates to other facilities, according to NPR.

NJDOC denies any wrongdoing, and the Court has not ruled in favor of either party in this case. Instead, the parties have agreed to the settlement.

Edna Mahan Correctional Facility Settlement Benefits

Benefits provided under the settlement agreement have been divided into three tiers.

  • Tier 1: Each Class Member submitting a claim will receive at least $1,000, plus $20 per month or partial month she was assigned to Edna Mahan Correctional Facility since Jan. 1, 2014, regardless of whether she directly experienced sexual abuse or harassment.
  • Tier 2: A Class Member who claims to have been the victim of sexual harassment must submit a sworn affidavit or certification of her claim and has the option to submit supporting documentation and request a hearing before the special master. These Class Members may receive total compensation of up to $4,500. 
  • Tier 3: Class Members who claim to have been the victim of sexual abuse must submit a sworn affidavit or certification about their claim with supporting documentation and must participate in a hearing before the special master. Class Members filing these claims may receive total compensation of up to $250,000.

Tier 1 claims are expected to be paid by Jan. 27, 2022. Tier 2 and 3 claims will be paid 90 days after all awards have been heard and decided.

In addition to financial compensation, NJDOC and the other defendants have agreed to implement the use of body cameras to be worn by all department staff who regularly are in contact with Edna Mahan Correctional Facility inmates.

A final fairness hearing in the Edna Mahan Correctional Facility settlement is scheduled for Oct. 15, 2021.

The deadline to opt out of or object to the settlement is Sept. 14, 2021.

The deadline to file a claim is Oct. 29, 2021

Who’s Eligible

The Class is made up of anyone who is or was, at any time since Jan. 1, 2014, a woman inmate in the custody of the New Jersey Department of Corrections (NJDOC) who was assigned to Edna Mahan Correctional Facility for Women in Union Township, New Jersey.

Tier 1: No documentation needed.
Tier 2: An affidavit or certification describing the sexual harassment you claim you experienced. Claimants selecting this tier also have the option of submitting contemporaneous corroborating documentation with their claim and requesting a hearing.
Tier 3: A separate affidavit or certification describing the sexual abuse you claim you experienced plus contemporaneous corroborating documentation. A hearing is mandatory for Tier 3 claims.

    Good Evening Everyone if you’re seeing this comment please 🙏🏾 take action. Please contact the commissioners office as well as the ombudsman office . Report to them that these people are withholding our money & not paying us for over 2-3 years is absolutely ridiculous please STEP ON THE GAS PEDAL, because now they’re taking advantage of us & not paying us they lied about the date continuously I don’t even think they’re still paying us. Call & complaint to these other offices so someone can overlook them . Governor, obudsman, commissioner . Because this is unacceptable it doesn’t not take this long to receive a settlement

      I called in November in the lady told me the state of NJ has a debt lean on the money we should start getting checks in early2023

    I was there from 2015 to 2019 and I had HORTON AND HAWKINS IN CONNOVER when it was still a TC Program and after they went to max…he was the biggest pig .used to make me wash the floor on my hands and knees and say nasty things to me and the other grls

          Ok. This is what I learned. They sent out letters in January for those claims they deemed valid. If you did not receive a letter, you have been denied. Regardless.

      well I guess a lot of people have been denied but what has been really strange not one person post or commented recieving a w9.the only thing I recieved from them was my exhibit c letter letting me know they had recieve my claim and it was nothing else I need to do.but I guess they forgot about those letters they sent out if anyone has info update please share good luck to you all

    I just received another opt out form, if I wanted to opt out of the settlement, from the attorneys. Just this week! So, that tells me they’re still reviewing people’s applications that are being sent in. This is ridiculous. I wouldn’t be surprised if it takes an additional 3 months from now before we see any settlement checks.

      they are lying extended claim 01/10/2022 which is over just finding away to delay only to collect interest from the money,but I see a lot of settlements are operating the same.but thanks for your comment

      I was told that those who received a letter in January will receive part of the settlement. Anyone who did not receive a letter in January means their claim was deemed invalid. W9s was supposed to have been sent out and returned by May 13th. I haven’t seen anyone posting they received a w9.

    I just think it’s unfair how you have people wait after you said certain dates to file and when we would receive do we have to bring you back to court to receive our payment that we deserve ? There is no reason why there should be a hold up . We will take you to court again

    On Feb 2nd, 2022, I Contacted the claims dept re the check mail date. I was told they’re still reviewing claim participants and they could not give a mail date for the checks.
    I do believe we will receive them, but when? My GUESS is sometime near the end of Feb.

      I was told the same thing in a email I receive from them, today made 30 days from January 10 for claims forms dead line so I believe tier 1 checks will go out the end of this month also good luck to you all that have filed
