Women who were inmates at the ​​New Jersey Department of Corrections’ (NJDOC) Edna Mahan Correctional Facility for Women since 2014 may be eligible to benefit from a $7,985,600 class action settlement resolving alleged abuses at the facility.

The Class is made up of anyone who is or was, at any time since Jan. 1, 2014, a woman inmate in the custody of the NJDOC who was assigned to Edna Mahan Correctional Facility for Women in Union Township, New Jersey.

Plaintiffs in class action lawsuits alleged female prisoners at Edna Mahan Correctional Facility were subjected to a pattern of sexual abuse and harassment by staff and that NJDOC administrators failed to prevent or remedy this conduct.

In June 2021, the New Jersey governor announced he intended to close Edna Mahan Correctional Facility for Women and relocate its nearly 400 inmates to other facilities, according to NPR.

NJDOC denies any wrongdoing, and the Court has not ruled in favor of either party in this case. Instead, the parties have agreed to the settlement.

Edna Mahan Correctional Facility Settlement Benefits

Benefits provided under the settlement agreement have been divided into three tiers.

  • Tier 1: Each Class Member submitting a claim will receive at least $1,000, plus $20 per month or partial month she was assigned to Edna Mahan Correctional Facility since Jan. 1, 2014, regardless of whether she directly experienced sexual abuse or harassment.
  • Tier 2: A Class Member who claims to have been the victim of sexual harassment must submit a sworn affidavit or certification of her claim and has the option to submit supporting documentation and request a hearing before the special master. These Class Members may receive total compensation of up to $4,500. 
  • Tier 3: Class Members who claim to have been the victim of sexual abuse must submit a sworn affidavit or certification about their claim with supporting documentation and must participate in a hearing before the special master. Class Members filing these claims may receive total compensation of up to $250,000.

Tier 1 claims are expected to be paid by Jan. 27, 2022. Tier 2 and 3 claims will be paid 90 days after all awards have been heard and decided.

In addition to financial compensation, NJDOC and the other defendants have agreed to implement the use of body cameras to be worn by all department staff who regularly are in contact with Edna Mahan Correctional Facility inmates.

A final fairness hearing in the Edna Mahan Correctional Facility settlement is scheduled for Oct. 15, 2021.

The deadline to opt out of or object to the settlement is Sept. 14, 2021.

The deadline to file a claim is Oct. 29, 2021

Who’s Eligible

The Class is made up of anyone who is or was, at any time since Jan. 1, 2014, a woman inmate in the custody of the New Jersey Department of Corrections (NJDOC) who was assigned to Edna Mahan Correctional Facility for Women in Union Township, New Jersey.

Tier 1: No documentation needed.
Tier 2: An affidavit or certification describing the sexual harassment you claim you experienced. Claimants selecting this tier also have the option of submitting contemporaneous corroborating documentation with their claim and requesting a hearing.
Tier 3: A separate affidavit or certification describing the sexual abuse you claim you experienced plus contemporaneous corroborating documentation. A hearing is mandatory for Tier 3 claims.

    I called the administration office. I got the number from the website. I called on Wednesday and they called me back in Friday. I was told that they received my information and they are still reviewing cases. So that just tells me don’t hold my breath.

      I wondering will Tier 1 checks will still go out 1/27 as stated I receive email respond back from them all I was told that they are still reviewing claims if anyone else have any info please share they also stated my claim had been receive

    I was in emcf age 20 in 1982-2020 the mess I went through saw and heard is unspeakable I was sexually harassed verbally(asked to suck their penis) countless times I was so young and scared I never told I would just brush it off and try to stay as safe as I could I saw people come and go staff administrators inmates you name it that place needed to be investigated years ago thank God I made it out the parole board violates the ex post facto law constantly it’s the grace of God and knowing that law got me out I need help filing a lawsuit against them now

        Yes that’s what it says but like u said u just received the form as did I an in the beginning of this article it claims that it has been settled or closed so why are we just getting the forms does that mean that they extended it or I’m not quite understanding so if somebody else can help us two ladies out we would appreciate it thank you

    yes I was in Randal and Williamason and a cottage I was in their from jan2/2014 and maxed out March 30/2016 it was a nightmare their and the officers were always sexually harassing me I couldn’t wait to max out.

    I was in there stayed in Randell, first time I had to watch sarges., office, so officers could use it with inmates.,

    I was on Edna Mahan correctional Facility in 2014 & 2015 in Conover and the way the officers would tear my room up which was always neat and tidy was just out of pure meanness and the way some officers would look at me and shine their lights on you while you were in your rooms were simply creepy especially officer Mays!

    My name is shenec quarles.i also was in clinton around this time.left for a halfway and came back to edna mahan correctional facility.the officers was very disrespectful. Calling us females dyke bitches”or they would mess our living quarters up just because they don’t like us.they put us females through so much stress being there.i was on medication because I couldn’t sleep from all the things they be doing at night to other females.how can you sleep with fear of one of them waking you up outta your sleep touching on you.one officer use to make his rounds at night and hold his flash light on what ever exposed piece of skin he could see on your body.they were very nasty.

      I was at Edna Mahan Correctional Facility from Jan 8 2014 until September 29 of 2016 I was beat and slammed on my head in detention by officer Holland I was forced to settle without them admitting wrong do I qualify for settlement I just got form in mail last week I sent it in by 10th
