Individuals who worked at XS Afterhours Gentlemen’s Club and The Palms Gentlemen’s Club may be eligible to benefit from a $375,000 class action settlement with the company that operates the clubs.

The Class consists of all individuals who worked as an independent contractor, lessee, employee, or other outside entertainer providing bikini, semi-nude, and/or nude entertainment for 2523 E. Anaheim Inc. doing business as XS Afterhours Gentlemen’s Club or the Palms Gentlemen’s Club in the State of California between May 2, 2015, and Feb. 24, 2021.

Two class action lawsuits had alleged the Class Members were misclassified as independent contractors, and therefore were denied appropriate wages and overtime compensation, meal and rest breaks, business expense reimbursement, and other rights guaranteed by the California Labor Code.

XS Afterhours Gentlemen’s Club operates at 2523 E. Anaheim St. in Wilmington, California, while the Palms Gentlemen’s Club operates at 2540 N. Palm Drive in Signal Hill, California.

The Court has not ruled in favor of either party in this class action.

In order to receive a payment, Class Members must complete a claim form and substitute Internal Revenue Service Form W-9.

Each claimant’s payment amount will be based on the number of shifts they worked during the Class Period.

Each performer is expected to receive approximately $13.58 to $27.16 per shift, in addition to the injuntive relief of being converted to an employee.

The exact amount of each payment will not be determined until after the Class notice process concludes and the Court grants the settlement final approval.

The claim forms require claimants to enter a Claim ID and PIN Code found on the notice that was mailed to potential Class Members.

Those who did not receive a notice but believe they are Class Members should fill out and submit a claim form via mail.

Class Members who have a change of address before receiving their payment are asked to notify the settlement administrator at 1-866-795-5072.

A final hearing will be held Sept. 7, 2021.

The deadline to object to or opt out of the gentlemen’s club settlement is Aug. 23, 2021.

The deadline to file a claim is also Aug. 23, 2021.

Anaheim Inc. doing business as XS Afterhours Gentlemen’s Club or the Palms Gentlemen’s Club in the State of California between May 2, 2015, and Feb. 24, 2021.

Each claimant’s payment amount will be based on the number of shifts they worked during the Class Period.
