  • SiriusXM has been hit with another class action lawsuit alleging violations of the Telephone Consumer Protection Act (TCPA), three years after the company agreed to a class action settlement worth $32.4 million arising from claims that the satellite radio service violated the TCPA.
  • In a complaint filed Feb. 15 in an Illinois federal court, plaintiffs Julie Campbell, Keith Sadauskas, Diana Bickford and Kerrie Mulholland say theyโ€™ve never paid for the radio service but bought vehicles equipped for it. They say the company obtained their contact information through their respective car dealerships and that telemarketing calls have continued โ€œunabated.โ€ย 
  • However, SiriusXM slammed the lawsuit, saying that while it is a new complaint with new plaintiffs, the case brings the same claims that it already settled with the same lawyers. It said that settlement also included changes to Siriusโ€™ business practices that plaintiffsโ€™ lawyers at the time called โ€œmeaningful.โ€ย ย

SiriusXM has for years been placing unlawful and unsolicited telemarketing calls urging car owners โ€” including those with numbers on the National Do Not Call Registry โ€” to sign up for its satellite radio service, a new class action lawsuit alleges.ย 

Plaintiffs Julie Campbell, Keith Sadauskas, Diane Bickford and Kerrie Mulholland claim Sirius XM has been making the telemarketing calls in violation of the Telephone Consumer Protection Act (TCPA).ย 

Campbell, Sadauskas, Bickford and Mulholland argue SiriusXM is โ€œwell awareโ€ that it is engaging in unlawful conduct with the telemarketing calls, having reached two settlement agreements in the past decade worth over $60 million.ย 

Further, Campbell, Sadauskas, Bickford and Mulholland claim hundreds of consumers have contacted the Federal Trade Commission about having received unsolicited telemarketing calls from SiriusXM.

โ€œEven with all these complaints and the millions spent, Sirius XM has continued its illegal calls unabated,โ€ the class action states.ย 

SiriusXM accused of violating laws from several states in the U.S.ย 

Campbell, Sadauskas, Bickford and Mulholland want to represent several classes, including nationwide classes of consumers with telephone numbers on the National Do Not Call Registry and those who registered their numbers with SiriusXMโ€™s company-specific Do Not Call Registry.ย 

The group also want to represent subclasses of consumers from Illinois, Washington, and North Carolina who registered their telephone numbers with SiriusXMโ€™s company-specific Do-Not-Call Registry.ย 

In addition to allegedly violating the TCPA, SiriusXM is accused of violating the Illinois Telephone Solicitations Act, the North Carolina Telemarketing Lawย and the Washington Do Not Call Statute.ย 

Plaintiffs are demanding a jury trial and requesting injunctive relief along with an award of statutory damages for themselves and all class members.ย 

A similar class action lawsuit was filed against SiriusXM last month by an individual arguing the company broke the law by using an auto-dialer to send โ€œannoyingโ€ and โ€œunsolicitedโ€ sales calls to consumers in Florida.ย

    SiriusXM doesnโ€™t stop emailing my account for 2022, 2023 and 2024 about my Sirius XM account will be cancelled after I already have had no uses since 2022. Contracts are a consumer rip-off!

    I bought a new car in 2013. It came with free Sirius service for the first 12 months, after which time it stopped working. I didnโ€™t think any more of it until by accident a couple of years later I realized what the strange charge on my credit card. After a lot of waiting I was put through to someone who said they would cancel it. Forgot about it again until 2019, then the same thing happened again. Same process, same pain. And now, guess what? Same again. I just cancelled it but this time got a proper confirmation #. But Iโ€™m done with these guys. They turned off the service, so itโ€™s not even like I knew I was supposed to be getting it. I would be happy to join a suit.

    How about a class action suit for them charging people who never ordered the service. Second occurrence of them just charging me for something I donโ€™t even have. No idea how they got my information as I no longer have the new car or trial. Cancelled multiple times but theu just start again. Guess I need to cancel that bank account.

    add me to the list, had Sirius for 3 years sold the ruck they wonโ€™t turn it off and keeps trying to charge my card

    Please add me โ€“ I called Sirius today to cancel my service and they had an automated message that wanted to add a โ€œpremium planโ€ โ€“ saying it was 14.99 per month โ€“ and by the time they added the US Music Royalty fees and taxes, it was $18.46. I said NO loudly and clearly each time it asked and they STILL put the plan through and charged my card. Could NOT get a live person on the phone. Went to Live Chat online and took over an HOUR to get it corrected and they saifd it would take 3-5 days to process the credit. Can you say ILLEGAL!

    I to have them calling me multiple times a day. I block that number and they use a different one. I do not have or renewed the subscription after the free trial ended. They donโ€™t get the hint. Add me to the list
