
Norwex calls class action lawsuit overview:

Norwex sends consumers unsolicited and prerecorded telemarketing messages and calls without receiving the required express written consent, a new class action lawsuit alleges.
Plaintiff Deborah Mahler claims Norwex is invading the privacy of the consumers it contacts in an effort to promote its goods and services.
Mahler argues Norwex’s alleged misconduct has ultimately resulted in “the invasion of privacy, harassment, aggravation, and disruption of the daily life of thousands of individuals.”
“Defendant’s unsolicited prerecorded messages caused Plaintiff additional harm, including invasion of privacy, aggravation, annoyance, intrusion on seclusion, trespass, and conversion,” the Norwex class action states.
Mahler wants to represent a nationwide class of consumers who received telemarketing calls from Norwex or on the company’s behalf that had a prerecorded or artificial message.
Norwex never received express written consent to send prerecorded telemarketing voice messages, class action says
Mahler claims she was “easily able” to identify that the telemarketing voice message she allegedly received from Norwex was prerecorded and that she was not hearing from a live person.
Further, Mahler argues she never provided Norwex with the express written consent she claims would be needed for the company to legally contact her with a prerecorded telemarketing message.
“At no point in time did Plaintiff provide Defendant with her express written consent to be contacted for marketing purposes by prerecorded messages,” the Norwex class action states.
Mahler claims Norwex is in violation of the Telephone Consumer Protection Act (TCPA). She is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual and statutory damages for herself and all class members.
Norwex initiated a recall last year for 40,000 ceramic knives sold in the U.S. and 2,500 sold in Canada over concerns they could break mid-use and become a laceration hazard.
