Class action lawsuits accusing GM of using OnStar units to collect and share vehicle driver data with a data analytics company without consent have been consolidated by the Judicial Panel on Multidistrict Litigation (JPML) in Georgia federal court.
The JPML said Georgia was the appropriate place for the GM driver data complaints to be consolidated into an MDL since it is the headquarters of LexisNexis Risk Solutions, which consumers argue GM shared data with without consent, causing their auto insurance premiums to increase.
A total of seven cases from California, Florida, Michigan, New York and Pennsylvania — along with any additional tag-along suits — were ordered by the JPML to be consolidated in Georgia federal court.
Additionally, 13 cases from Alabama, California, Michigan, Minnesota and New York were also transferred to Georgia, according to court documents.
Complaints against GM came in wake of congressional inquiry
The class action lawsuits were filed against GM — along with OnStar, LexisNexis and Verisk Analytics — in the wake of a September 2023 investigation by the Mozilla Foundation that led to a congressional inquiry, reports Law360.
The inquiry reportedly led Sen. Edward Markey, D-Mass. to ask the Federal Trade Commission to investigate the data privacy practices of automakers.
One of the now-consolidated class action lawsuits was filed by a consumer against GM, OnStar and LexisNexis earlier this year over claims they were denied insurance coverage after their driving information was allegedly recorded by OnStar and shared by GM with LexisNexis.
The consumer argued that, despite the shared data allegedly being “so decontextualized that it can hardly be called accurate,” that insurance companies “rely upon” those types of reports “to determine pricing or flatly reject a potential customer,” as allegedly happened in their case.

2023 Chevy Bolt EV, bought Feb 2024. We declined Onstar in our initial phone call, yet Chevy signed us up anyway! We only called Onstar because our sales rep said he gets in trouble if we don’t. Later we called them back to say, explicitly for the record, we don’t want our data shared. But the hapless Onstar phone rep said they had no way to tell, and could do nothing.

This explains so much! Every year my GM equipped with OnStar the Insurance keeps going up even though I haven’t had an insurance claim, accident or ticket in 38 years.
