A new Jaguar Land Rover class action lawsuit alleges the automaker installs tracking software in its vehicles that surreptitiously records driver behavior and other personal data.
Plaintiffs Gail J. Hupper and William H. Wood claim their 2023 Land Rover Defender 110 supports driver tracking software or applications that can be used to collect drivers’ data. They claim Jaguar Land Rover fails to notify drivers their customer data will be collected and/or sold to third parties, some of which may resell the data to insurance companies, potentially resulting in higher auto insurance quotes or premiums.
“The software and applications allow JLR to record, store and transmit data not just about vehicle condition (e.g. engine or transmission status, etc.), but also driver behavior,” the plaintiffs claim in the Jaguar Land Rover class action lawsuit.
Jaguar Land Rover class action says drivers weren’t notified about data collection
A software update notice appeared on their vehicle’s dashboard screen a few months after they purchased the vehicle, cluing them in to the fact their vehicle was connected to the internet. The plaintiffs investigated Jaguar Land Rover’s data collection practices and they allegedly discovered driver information was collected and sold without their knowledge or consent.
Had they known about Jaguar Land Rover’s data collection practices before purchasing their Land Rover, they say they may not have purchased the vehicle.
Hupper and Wood filed the Jaguar Land Rover class action lawsuit on behalf of themselves and a proposed class of drivers whose JLR vehicles recorded customer data and shared and/or sold their data to third parties.
The Jaguar Land Rover class action lawsuit asserts claims for violations of the Fair Credit Reporting Act, violations of various state consumer protection acts, tortious interference, invasion of privacy and unjust enrichment.
Hyundai and Kia are also facing a class action lawsuit claiming the automakers have been selling information about driver behavior without the drivers’ knowledge or consent.
