T-Mobile Data Breach Class Action Consolidation Overview:

  • Who: The Judicial Panel on Multidistrict Litigation has agreed to consolidate 44 class action lawsuits lobbied against T-Mobile in the Western District of Missouri.
  • Why: The panel agreed with T-Mobile that the venue is proper due to its central location and capacity to manage the case.
  • Where: The decision was made by the U.S Judicial Panel on Multidistrict Litigation.

The Judicial Panel on Multidistrict Litigation has agreed to let T-Mobile consolidate in the Western District of Missouri dozens of class action lawsuits lobbied against the company over an August data breach that exposed the data of millions of its customers

The panel agreed with T-Mobile’s previous argument that the complaints should not be consolidated in Washington state due to a shortage of available judges.

In a transfer order filed on Dec. 3, the panel said the Western District of Missouri was a proper venue for litigation due to its central location and “capacity to efficiently manage” the case.

A total of 44 cases have now been consolidated into the state of Missouri — up from five at the time of the panel’s initial transfer order, Law360 reports.

Data Breach Exposed The Pricatre Data Of More Than 50 Million Customers

The class action lawsuits revolve around an August data breach, which T-Mobile has acknowledged exposed the private data of more than 50 million of its customers.

Information that was exposed in the data breach included names, phone numbers, Social Security numbers and dates of birth. Customers who had applied for credit with the company were the most affected group, according to T-Mobile.

The 44 class action lawsuits, meanwhile, claim T-Mobile is, among other things, guilty of negligence and breach of confidence and in violation of the Federal Trade Commission Act and California’s novel consumer privacy law.

Only one plaintiff had argued to have the cases consolidated in Missouri, meanwhile, with others pushing for the Eastern District of New York, the District of New Jersey, the Western District of Washington and the Western District of Oklahoma, Law360 reports.

The plaintiffs are represented by Abington Cole & Ellery, Held & Hines LLP, Kessler Topaz Meltzer & Check LLP, Carella Byrne Cecchi Olstein Brody & Angello PC, Seeger Weiss LLP, Lowey Dannenberg PC and the Law Offices of Ronald A. Marron.

The Consolidation Proceedings are In re: T-Mobile Customer Data Security Breach Litigation, MDL No. 3019, before the U.S Judicial Panel on Multidistrict Litigation.

  1. Shawn Rhoderick says:

I wasn’t aware of this breach until settlement news recently, but now things are starting to add up. I was hit hard a few months ago with attempts at mail diversion and CC fraud. I was very curious how my current address would have been leaked. I would have been a former TMobile customer at the time of breach (cancelled less than a year before breach). I would think my breached data sat around on the web the last year, and just now someone bought some files and made a fraud run. Unfortunately TMobile did a poor job informing me, but my credit is locked down tight now.
