Insurance broker Arthur J. Gallagher Co. has put thousands of its customers at risk by failing to safeguard their personally identifiable information and allowing it to be stolen in a 2020 data breach, a new class action lawsuit alleges.

The Arthur J. Gallagher Co. class action lawsuit was filed in Illinois by lead Plaintiffs Jason Myers and John Parsons who allege that the company violated state and federal laws by failing to implement adequate security systems or meet minimum industry data security standards, and by not telling consumers or employees that their personal information had been exposed in a timely manner, Law360 reports.

Parsons, who worked for Gallagher from 1996 to 1999, says in the claim that while he was employed with the company, he was required to give the company his personal information.

Although the breach — which occurred between June and September 2020 — happened more than 20 years after Parsons left the company, he still had his data caught up in it.

According to the Arthur J. Gallagher Co. data breach claim, Gallagher waited several months to report the breach to local leaders after learning about it in September, and the company didn’t take measures to notify class members until June.

Myers received notice of the breach on July 2 informing him that his name and his medical claim information had been exposed, the claim alleges.

“As a result of this delayed response, plaintiffs and class members had no idea their PII had been compromised, and that they were, and continue to be, at significant risk of identity theft and various other forms of personal, social, and financial harm. The risk will remain for their respective lifetimes,” Myers and Parsons say in the claim.

Because of Gallagher’s negligence, hackers have now accessed personal data from thousands of consumers, employees, and others, including Social Security numbers, credit card information, and electronic signatures, the claim alleges.

The consumers allege that Gallagher’s failings constitute an unfair act or practice prohibited by the Federal Trade Commission Act.

“Defendants were at all times fully aware of their obligation to protect the PII of customers, prospective customers and employees,” Parsons and Myers allege. “Defendants were also aware of the significant repercussions that would result from their failure to do so.”

The pair are seeking to represent a nationwide class of Gallagher customers whose personally identifiable information was compromised in the breach. They are suing for negligence, breach of implied contract, unjust enrichment, and violations of various Louisiana and California consumer protection laws.

They also want a declaration that Gallagher must implement and maintain reasonable security measures, including engaging third-party auditors and running regular security checks, and must pay for credit monitoring services for nationwide class members for 10 years, Law360 reports.

    Today on August 30th 2021 I received a letter from Arthur J. Gallagher & Co. (“Callagher”)…informing of a data breach that happened to their systems almost a year ago between (June 3rd 2020 and September 26th 2020) with my personal, medical and financial information was compromised and possibly even stolen….I truly hope that this too isn’t just another scam and if it is true then please add me to this class action lawsuit….thank you in advance….

    I received 2 letters today.. I have never used Gallagher. Why would the have my information to begin with? I believe this is a Scam to get you to pay for protection.

    My daughter’s and mine name, social security number’s, DOB and health information were breached. In the letter it says if you have any questions call the provided number. The provided number is a different company that Gallagher hired to answer questions. I was told that the only information this company was supplied from Gallagher was my name, address and a copy of the letter that was mailed out to me. They had no answers at all. They took down my questions and said they would contact Gallagher and get back to me. That was a month ago. Still haven’t heard from anyone. They took 10 months after my breach to inform me of that breach and now they won’t even answer any questions. about it. Gallagher is not taking this event that could affect us for the rest of our lives seriously at all.

    Just got a letter August 27 2021 from Gallagher Bassett telling me of the data breach. I was hurt at work in 2014 and I’ve been permanently disabled and Gallagher Bassett fought me nonstop. everything just got settled in March a 2020. Gallagher Bassett screwed me over big time and it looks like they’re gonna be able to do it again.

    I just received the letter today as Gallagher Bassett was the insurance company that handled my New York State workermans compensation case back in 2006. It says the hackers have my social security number and name. I can only assume they have my date of birth as well. I’d like to be a part of this lawsuit please.

    My son received a letter regarding the breach as well, dated 8/17/2021. Wanted to search on this to make sure is was not a scam! It sure took them long enough to notify us. Now my son will have to check his credit reports to make sure his information has been used.

    I also received the letter.what does all this mean.ive been goin thru some identity issues with the unemployment agency.had to use ID me what a pain.i have alot of ?? About all this hoping to get some answers here.
