Casino data breach overview:

Harrington Raceway failed to properly secure and safeguard its employees’ personally identifiable information, including names and Social Security Numbers, that were then exposed in a data breach, a new class action lawsuit alleges.

Plaintiff Jaysin Hoyle filed the class action lawsuit against Harrington Raceway Inc. on April 17 in a Delaware federal court, alleging negligence. 

The defendant is a harness racing track and casino on the fairgrounds of the Delaware State Fair. Hoyle alleges that he provided his private information to the company in order to work for it as a line cook.

“Despite their duties to Plaintiff and Class Members, Defendant stored their Private Information on a database that was negligently and/or recklessly configured,” his lawsuit states. 

“This misconfiguration allowed files on the database to be accessed without a password or any form of multifactor authentication.”

Information allegedly listed on dark web

On or around Dec. 27, 2022, the casino became aware of suspicious activity affecting its network, the lawsuit states.

It immediately began an investigation, and on Feb. 1, 2023, Harrington confirmed certain information in its systems may have been accessed or taken without authorization between Dec. 12 and 27, 2022, the lawsuit states.

The plaintiff says the information was then listed on the dark web.

“Given the theft of information that is largely static — like Social Security numbers — this risk will remain with Plaintiff and Class Members for the rest of their lives, ” Hoyle said. 

As a result, the plaintiff is suing on behalf of anyone who had their private information exposed in the breach. 

Hoyle is suing for negligence and unjust enrichment and seeks certification of the class action, damages, fees, costs and a jury trial. He also seeks an order forcing the company to improve its data security and security of private information.

Rancho Mesquite Casino is also facing a class action lawsuit alleging it left its computer systems vulnerable to a cyberattack during a Nov. 2022 data breach that exposed the personal information of more than 200,000 customers and employees, another new class action lawsuit alleges.
