A settlement has been secured in a pair of Burgerville data breach class action lawsuits that alleged the Oregon-based chain failed to protect customers’ debit and credit card information.
Class Members include those who used a credit or debit card to make a purchase at any Burgerville restaurant between Sept. 12, 2017 and Sept. 30, 2018.
According to the Burgerville data breach class action lawsuits, the chain announced a “security incident” on Oct. 3, 2018. The security incident was reportedly a cyberattack on Burgerville’s network.
The plaintiffs claimed that the data breach was perpetrated by an international hacking organization. Burgerville, however, failed to implement proper security measures to protect consumers’ financial information, contended the complaint.
The Burgerville data breach class action lawsuit alleged that credit and debit card numbers, expiration dates, and CVV numbers, along with customer names, were compromised in the attack.
Burgerville has admitted no wrongdoing, but agreed to settle the data breach class action lawsuit by offering to pay for credit monitoring for Class Members, as well as for out-of-pocket expenses and reimbursement for lost time.
Under the terms of the Burgerville data breach class action settlement, Class Members can claim free credit monitoring service for two years through AllClearID. Burgerville had offered this service to Class Members prior to the settlement agreement.
In addition, Class Members who incurred out-of-pocket expenses in the effort to protect their personally identifiable information can claim reimbursement for those expenses. Expenses can be up to $250 and includes costs associated with credit monitoring, identity theft insurance, credit reports, credit freezes, canceling or replacing bank cards or bank accounts, and other incidental expenses. Documentation of such expenses must be provided.
Class Members who were subject to fraud or identity theft can claim compensation for lost time at $15 an hour for up to six hours. Additionally, these Class Members can claim up to $3,000 in reimbursement for costs associated with identity theft resulting from the Burgerville data breach. Documentation of these expenses will need to be provided as well.
To make a claim, Class Members must submit a Claim Form either online or by mail. Documentation, if necessary, must be provided as well.
Class Members who wish to exclude themselves or object to the Burgerville data breach class action settlement must do so by March 5, 2020. The final approval hearing for the settlement is scheduled for April 6, 2020.
Who’s Eligible
Class Members include those who “used [a] debit or credit card to make a purchase at a Burgerville restaurant from September 12, 2017 through September 30, 2018.”
Potential Award
Free credit monitoring service for two years and up to $3,000 in expense reimbursement:
- Those who incurred out-of-pocket expenses, but did not experience identity theft, can claim up to $250.
- Those who incurred out-of-pocket expenses and experienced identity theft can claim up to $3,000.
Proof of Purchase
Class Members claiming out-of-pocket expenses must provide documentation of those expenses.
