Metromile Data Breach Class Action Lawsuit Overview:

Auto insurance provider Metromile’s negligence and carelessness with consumer information exposed those consumers to a “lifetime risk of identity theft” after a data breach saw their personal information compromised, a new class action lawsuit alleges.
The lawsuit was filed in California by lead plaintiff Lowell Parker who alleges that Metromile, Inc breached contracts with drivers and was negligent with their personal information, resulting in a data breach in between July 2020 and January 2021.
“Not only did hackers discover Metromile’s inadequate safeguards and exploit this ‘bug’ to steal the PII [personal identifying information] of Plaintiff and Class Members, but, criminals have already used the PII to attempt to steal certain of Plaintiff’s and Class Members’ identities,” Parker says, adding the information has great value to hackers.
Metromile Data Breach Info On Dark Web
Drivers’ personal information, including his own, is still available and may be for sale on the dark web for criminals to access and abuse, he alleged, saying that consumers who interacted with Metromile face a present and increased, lifetime risk of identity theft.
On March 3, the New York State Department of Labor notified Parker that an unauthorized third party filed a “claim for unemployment insurance benefits” using his personal information, the claim reads. “Mr. Parker did not apply for these benefits.”
It adds that he suffered actual injury of damages to and diminution in the value of his personal data — a form of intangible property that Metromile “did not adequately safeguard.”
“Mr. Parker also suffered lost time, annoyance, interference, and inconvenience as a result of the Data Breach and has serious concerns for the loss of his privacy.”
The class action lawsuit alleges that Metromile failed to adequately protect consumers’ PII; warn its customers, potential customers, and other consumers of their inadequate information security practices; and effectively monitor their websites and platforms for security vulnerabilities and incidents.
The company’s conduct amounts to negligence and violates federal and state statutes, Parker alleges.
Parker wants to represent consumers in the United States affected by the Metromile data breach. He is suing for negligence, breach of implied contract, unjust enrichment, and business law violations, and seeks certification of the Class, order of enjoinment, injunctive relief, damages, legal fees, interest, and a jury trial.
Earlier this year, competitor insurance company Geico warned consumers of a months-long data breach that exposed drivers license numbers.
