Current and former Brown-Forman employees whose information may have been compromised during a 2020 data breach may be eligible to seek compensation thanks to a class action settlement.

Class Members are individuals whom Brown-Forman notified that their personal information was or may have been compromised during the data breach.

Brown-Forman discovered July 28, 2020, it had been the target of a cyberattack and in August 2020 notified current and former employees whose information may have been accessed. 

A class action lawsuit alleged Brown-Forman did not adequately protect Class Members’ personal information.

The company denies all allegations of wrongdoing.

Brown-Forman is a maker of alcoholic beverages. Its brands include Jack Daniel’s, Woodford Reserve, Old Forester, El Jimador, Finlandia, Korbel, Chambord, and many others.

The company has more than 4,700 employees worldwide.

Class Members are eligible to make claims for reimbursement of out-of-pocket losses and time, as well as for payments for inconvenience.

To be reimbursed for out-of-pocket expenses, Class Members’ incurred expenses that are fairly traceable to the data breach must not have been reimbursed by insurance provided through Experian IdenityWorks.

Examples of this type of loss include:

  • Expenses incurred as a result of identity theft or identity fraud, falsified tax returns, or other misuse of personal information
  • Costs incurred on or after Aug. 25, 2020, that were associated with accessing or freezing or unfreezing credit reports
  • Other related expenses, such as notary, postage, long-distance telephone charges, and others

Class Members are eligible for expense reimbursement of up to $5,000.

Individuals who spent time remedying issues related to the data breach may claim up to $20 per hour for up to eight hours, for a total of $160.

Those making a claim for time must provide their contact information as well as the actions they took and the time each action took. 

Class Members may make a claim to receive up to $250 for their inconvenience if they submitted and received an insurance payment through Experian IdentityWorks that was related to the Brown-Forman breach.

To receive this payment, the Class Member must sign up for Experian IdentityWorks by submitting a claim for identity protection. Class Members must submit a completed claim form for other benefits by the date on which their Experian IdentityWorks provided under the settlement expires.

To be eligible for these payments, Class Members must submit a completed claim form for other benefits by the date on which their Experian IdentityWorks provided under the settlement expires.

Under the terms of the settlement, Brown-Forman also has agreed to provide identity theft protection coverage, including credit monitoring from all three major credit reporting bureaus and $1 million in identity theft insurance.

Class Members must file a claim in order to receive this benefit.

Brown-Forman also has agreed to implement certain measures for at least three years after the settlement’s effective date, including enhanced cybersecurity awareness and training, further restricting access to personal information, and enhanced monitoring and response capabilities, among other steps.

A final approval hearing in the Brown-Forman data breach settlement will take place Aug. 11, 2021.

The deadline to opt out of or object to the settlement is July 7, 2021.

The deadline to submit a claim form for identity protection is also July 7, 2021.

Who’s Eligible

Individuals whom Brown-Forman notified that their personal information was or may have been compromised during the data breach.

Potential Award

Up to $5,000.

  • Class Members are eligible for expense reimbursement of up to $5,000.
  • Individuals who spent time remedying issues related to the data breach may claim up to $20 per hour for up to eight hours, for a total of $160.

Proof of Purchase

Claim for reimbursement of out-of-pocket losses must be accompanied by the Class Member’s contact information and documents that show what happened and how much they lost or spent so they can be repaid. They must also submit documents showing Experian IdentityWorks denied their claim(s). Handwritten receipts are, by themselves, not enough to receive reimbursement.

Claims for reimbursement for attested time must be accompanied by the Class Member’s contact information, as well as details about the actions they took in response to the data breach and the time each action took. Class Members must also attest that the information is provided under penalty of perjury.

Claims for a cash payment for inconvenience must be submitted along with the Class Member’s contact information and documentation showing the insurance payment by Experian.
