NAVICENT HEALTH SETTLEMENT UPDATE:

Consumers whose data may have been compromised during a 2018 Navicent Health data breach may be able to take part in a class action settlement.

The Class is made up of anyone who previously received a notification from Navicent Health about the July 2018 data incident.

A class action lawsuit claimed Navicent Health was responsible for the data breach and accused the company of negligence, breach of contract, and other wrongdoing.

The compromised information included names, dates of birth, Social Security numbers, medical information, protected health information as defined by the Health Insurance Portability and Accountability Act of 1996 (HIPAA), among other data.

The facility denies all accusations of wrongdoing.

Navicent Health, part of Atrium Health Navicent, is a 637-bed trauma hospital in Macon, Georgia.

Navicent Health Settlement Claims

Class Members may submit claims for two types of payment: expense reimbursement and extraordinary expense reimbursement.

Class Members seeking expense reimbursement are eligible to receive a payment of up to $200 for the following categories of out-pocket expenses that resulted from the Navicent Health data breach:

  •  bank fees, long-distance phone charges, cellphone charges if charged by the minute, data charges if charged based on the amount of data used, postage, or gasoline for local travel
  • fees for credit reports, credit monitoring, or other identity-theft insurance products purchased between March 22, 2019, and the date of the close of the claims period, if it was purchased primarily because of the breach
  • reimbursement of up to four hours of documented lost time at a rate of $15 per hour for time spent dealing with the data breach, such as time spent dealing with replacement card issues, reversing fraudulent charges, or rescheduling medical appointments. At least one full hour must have been spent, and Class Members may only seek this relief if the time can be documented with reasonable specificity by answering the claim form 

Class Members may seek up to $2,500 in compensation for extraordinary unreimbursed monetary losses due to their information being compromised.

To submit such a claim, Class Members must demonstrate that the loss is an actual, documented, unreimbursed monetary loss likely caused by the data breach, and that the loss occurred between July 1, 2018, and the end of the claims period.

The loss must not have been covered by one of the categories for the expense reimbursement claims, and the Class Member must have made a reasonable effort to either avoid the loss or to seek reimbursement from credit monitoring insurance or other sources.

In addition to the monetary relief, Navicent Health agreed to make certain enhancements to its information security for 2020, 2021, and 2022.

Anyone who would like to opt out of or object to the Navicent Health settlement must do so by June 28, 2021.

A fairness hearing will take place Aug. 4, 2021.

The deadline to submit a claim is Aug. 26, 2021.

$2,500.
