Woman Sues Ethicon Over Gynecare Vaginal Mesh Implant Complications

By Andrea Gressman

transvaginal meshAfter suffering from serious complications from a Gynecare vaginal mesh implant, an unnamed Minnesota woman has filed a vaginal mesh implant lawsuit against Johnson & Johnson, Gynecare, and Ethicon. The Gynecare vaginal mesh implant lawsuit, originally filed in the Minnesota district of the US District Court on August 13, 2012, has been transferred to the vaginal mesh lawsuit MDL in the Southern District of Virginia as of August 29, 2012.

The terms of the Gynecare transvaginal mesh implant lawsuit indicate that the Plaintiff underwent surgery for stress urinary incontinence (SUI) and vaginal prolapse in June of 2005 and received vaginal mesh implants, including a Gynecare vaginal mesh implant, to treat these conditions. The Plaintiff then began to experience severe side effects of her vaginal mesh implants, which included intermittent vaginal bleeding and incontinence. Nearly three years after her original surgical procedure, the complications have become more severe.

In April 2008, a physical examination proved the Plaintiff was suffering from vaginal mesh erosion and was prescribed a topical cream. However, her symptoms continued. The Plaintiff has undergone multiple surgeries including one in May 2008 and then another on September 15, 2008, where they attempted to remove the vaginal mesh implant. According to her Ethicon vaginal mesh implant lawsuit, the Plaintiff may need additional surgeries in the future. In addition, she may suffer from a permanent disability due to the erosion of the vaginal mesh implant, which could significantly affect her for many years to come.

The Plaintiff is seeking compensation for the following:

* Pain and suffering
* Lost wages, disability
* Medical expenses
* Legal expenses

Vaginal Mesh Implant MDL vs. Vaginal Mesh Implant Class Action Lawsuit

You often hear the term “class action lawsuit,” but the term “MDL” may not be as popular. However, they are both very important aspects of the legal system. A vaginal mesh implant class action lawsuit and a vaginal mesh lawsuit MDL are similar because they allow hundreds of Plaintiffs to sue one company together. However, the MDL will allow each of the vaginal mesh implant lawsuit Plaintiffs to retain her own vaginal mesh lawsuit attorney. In the vaginal mesh lawsuit MDL, the Plaintiff is also allowed to keep her own individual settlement, which will be determined based upon that particular Plaintiff’s individual circumstance. For example, if one Plaintiff experienced more side effects due to the vaginal mesh implant, or a more severe side effect of the transvaginal mesh implant, then they may receive additional compensation. A vaginal mesh class action lawsuit settlement, on the other hand, would be split equally amongst all of the Class Members who participated in the class action lawsuit.

Serious Vaginal Mesh Implant Side Effects Lead to FDA Warning

Vaginal mesh erosion causes serious complications in almost 10% of its users. Vaginal mesh implants, transvaginal mesh implants and bladder sling implants are typically used for conditions such as stress urinary incontinence (SUI) and symptomatic vaginal prolapse. However, vaginal mesh implants have been reported to break down or erode, causing serious complications as a result of these side effects in many of its surgical recipients. Some of these transvaginal mesh implant effects include urinary incontinence and vaginal bleeding.

In July of 2011, the FDA issued a warning to the medical community as well as the public regarding these potential side effects of transvaginal mesh implants. Approximately one year later, in June 2012, Ethicon took a number of its vaginal mesh implant products off the market, including the following:

* Gynecare Prolift
* Gynecare TVT Secur System
* Gynecare Prosima
* Gynecare Prolift + M

The FDA statement also noted that the complications were occurring on a frequent basis and may require multiple surgeries to remove the vaginal mesh implant. In fact, in some cases it may not be possible to remove all of the vaginal mesh implant.

Other side effects of vaginal mesh implants, such as vaginal infections, bleeding, painful sexual intercourse, urinary issues and others have also been experienced by many of those with the transvaginal mesh implants and bladder sling implants.
