Woman Files Vaginal Mesh Implant Lawsuit Over Severe Side Effects

By Andrea Gressman

vaginal mesh implant side effectsVaginal mesh lawsuit lawyers filed a transvaginal mesh implant lawsuit on September 10, 2012 on behalf of a woman who suffered serious injuries from the device.  However, the case was removed to the United States District County in the Southern District of West Virginia. The vaginal mesh implant lawsuit claims that the plaintiff suffered injuries and side effects as a result of using the transvaginal mesh implant, which required corrective surgery. She aims to hold Johnson & Johnson and its subsidiaries accountable for her injuries, and thus, is seeking compensation for damages sustained while using the implant.

Many women seeking compensation for their injuries related to the vaginal mesh implants continue to file personal injury lawsuits and class action lawsuits against manufacturers with the help of a vaginal mesh implant lawyer.

Vaginal Mesh Implants Used to Incontinence & Pelvic Organ Prolapse

To treat stress urinary incontinence and pelvic organ prolapse, many women often have a vaginal mesh implant, transvaginal mesh implant or bladder sling implant surgically inserted. Usually pregnancy and giving birth are common causes for these side effects. Carrying a child may cause some of the organs to shift, thus putting pressure on the organs, which may cause bladder incontinence. Though vaginal mesh implants are considered a viable treatment for POP and SUI, there is significant evidence indicating that many of these vaginal mesh implants exacerbate, rather than alleviate, the problems.

Women have experienced many side effects associated with vaginal mesh implants. Infection and erosion are among the highest rate of side effects, though other problems are possible. Repairing the vaginal mesh implant through corrective surgery isn’t always effective due to the nature of the transvaginal mesh implant and its design of fusing with the vaginal wall. Bladders ling implants and vaginal mesh implant are sometimes difficult to remove.

Vaginal Mesh Implant Lawsuit Moved to West Virginia MDL

Though the plaintiff in this recent vaginal mesh implant lawsuit had originally filed her case in the Eastern District of Pennsylvania, it was consolidated with other surgical mesh implant lawsuits in West Virginia vaginal mesh implant lawsuit MDL. The plaintiff, along with other vaginal mesh implant plaintiffs, is seeking a settlement to help pay for the injuries she sustained.

The whole point of vaginal mesh lawsuit MDL proceedings are to conserve judicial resources, speed up the legal processes and allow one judge, as opposed to many, to make rulings and to streamline the litigation process. Consolidation of these vaginal mesh lawsuits serve to facilitate the due process and allow plaintiffs to receive their compensation faster.

According to the transvaginal mesh implant lawsuit, the plaintiff had the vaginal mesh implanted to treat a medical condition. However, the injury she suffered from the vaginal mesh implant became severe enough as to warrant corrective surgery. The defendants, according to the plaintiff, are at fault on the claims of negligence and product liability.
