Plaintiffs Request GranuFlo Lawsuit MDL

On December 12, 2012, a motion was filed by two GranuFlo lawsuit plaintiffs who both lost loved ones due to deadly GranuFlo/NaturaLyte side effects. The motions were filed with the United States Judicial Panel on Multidistrict Litigation and specifically requested that a GranuFlo lawsuit MDL would be established in the district of Massachusetts in order to consolidate the growing number of GranuFlo and NaturaLyte lawsuits currently being filed.
These GranuFlo and NaturaLyte lawsuits have been filed due to the severe side effects the dialysis concentrates have been linked to. Currently there are 11 GranuFlo lawsuits pending in eight different U.S. District Courts. However, many GranuFlo and NaturaLyte lawsuit attorneys expect this number to grow because of the number of patients that were exposed to the sever GranuFlo and NaturaLyte side effects.
A multidistrict litigation (MDL) consolidates lawsuits, like the GranuFlo/NaturaLyte lawsuits, that are all filed against the same defendant for similar reasons. When they are consolidated it helps streamline the litigation process. However, it is not like a class action lawsuit where they all have to share the settlement amount. Each case will still be ruled upon individually and an individual settlement awarded.
GranuFlo and NaturaLyte Lawsuits Claim Fresenius Knew of Side Effect Risks
In November of 2011 Fresenius sent an internal memo to all of the dialysis centers located in the Fresenius network warning them of severe side effects when GranuFlo and NaturaLyte are mixed incorrectly. However, this same memo was not sent to the other dialysis centers located outside the Fresenius network despite the fact that they used the GranuFlo and NaturaLyte dialysis products themselves. This put thousands of people at continued risk for GranuFlo heart attacks until the FDA started the investigation into the matter in March of 2012 when the memo was leaked to them, and then later when the FDA announced the recall of GranuFlo and NaturaLyte in June of 2012.
The GranuFlo and NaturaLyte lawsuits claim that Fresenius knew about the side effect risks and neglected to properly warn the many GranuFlo and NaturaLyte users. When Fresenius issued the warning internally they reported that there were 941 deaths due to the GranuFlo and NaturaLyte side effects in the year 2010 alone. Because of the time that went by where people were unknowingly using the dialysis products it is likely that this number has grown a great deal. This means that there are likely a number of patients out there that still are not aware that the GranuFlo or NaturaLyte that was used in their dialysis treatment was the cause of their heart attack.
GranuFlo and NaturaLyte Cause Heart Attacks as a Side Effect
GranuFlo and NaturaLyte are both used in dialysis treatment to prevent the possibility of acid buildup. They both come in concentrate form, GranuFlo a powder and NaturaLyte a liquid. However, they are made with different active ingredients than other similar products, which make them more potent. The physicians responsible for using the medication were not aware of this and so they were mixing it the same as they would any other product of this kind. As a result, the patients were essentially being overdosed, which led to severe and potentially fatal side effects like heart attacks.
As more awareness is brought out about the link between GranuFlo and NaturaLyte and heart attacks, it is believed that more GranuFlo and NaturaLyte lawsuits will be filed.
