Mother Died of Tylenol Overdose, Lawsuit Says

Tylenol overdoseNew York resident Marcia Miller is suing McNeil Consumer Healthcare and Johnson & Johnson, alleging that her mother died of a toxic acetaminophen overdose caused by the companies’ over-the-counter drug Tylenol. The products allegedly ingested by her mother prior to her death included a combination of Extra Strength Tylenol, Regular Strength Tylenol, Tylenol PM and Tylenol Extra Strength Nighttime. 

Miller’s mother, Megan Miller, took the OTC painkillers over a period of one month in 2010, thinking they were relatively safe. However, within a month, Megan died from liver failure caused by an acetaminophen overdose on June 1, 2010.


As part of the Tylenol liver damage lawsuit, Marcia is seeking compensation not only for the wrongful death of her mother, but also for loss of consortium, or the lost companionship of a loved one. Her Tylenol lawsuit was filed August 15, 2013, directly into multidistrict litigation (MDL) where dozens of other Tylenol liver damage lawsuits have been consolidated. 

The Tylenol Lawsuit Allegations

Marcia is suing the makers of Tylenol and other related companies for strict liability, breach of warranty, failure to warn, design defect, negligence, negligent misrepresentation, fraud, violation of consumer protection laws, fraudulent concealment, loss of consortium, punitive damages, discovery rule and tolling, wrongful death and survival action. 

Survivors of people who have died from Tylenol overdose often sue for medical expenses, ongoing medical care, a full refund of the drug and other expenses related to their health needs. Burial costs are another consideration. There are many expenses that go into a medical emergency such as this one.

Whether or not a person died from Tylenol liver failure does not matter when filing a lawsuit. Joining the Tylenol liver damage MDL may be an expedited avenue to getting compensation for alleged injuries. 

The case is Marcia Miller, et al. v. McNeill, et al., Case No. 13-cv-04790. It has joined the Tylenol liver damage MDL known as In Re: Tylenol (Acetaminophen) Marketing, Sales Practices and Products Liability Litigation, MDL No. 2436, the United States District Court Eastern District of Pennsylvania.
